The integration of smart contracts in blockchain in government contracting in Colombia

La contratación estatal en Colombia ha estado históricamente atravesada por problemáticas como la corrupción, los sobrecostos, la opacidad en los procesos y la lentitud administrativa, factores que han debilitado la confianza ciudadana en las instituciones y han limitado la eficacia en la ejecución de los recursos públicos. Frente a ello, la tecnología blockchain y los smart contracts se presentan como una alternativa innovadora al ofrecer trazabilidad, inmutabilidad y automatización en la ejecución de los contratos públicos, asegurando que las cláusulas pactadas se cumplan bajo condiciones previamente programadas y verificables.

Gobernanza Participativa y Presupuestos Democráticos: Análisis Crítico del Modelo de Gestión Municipal en Cotacachi, Ecuador (2015-2020)

This article analyzes the implementation of participatory budgeting as a democratic governance mechanism in the Decentralized Autonomous Municipal Government of Santa Ana de Cotacachi, Ecuador, during 2015-2020. Through a mixed methodological approach combining systematic documentary analysis of 147 official documents, 42 semi-structured interviews, participant observation in 12 deliberative sessions, and statistical analysis of management indicators, the institutionalization of the Cantonal Participation System and its multidimensional impact on local public management is examined. Results show that normative formalization through the 2016 Ordinance consolidated a two-decade participatory process, achieving mobilization of 8,347 unique citizens (21.3% of adult population) and execution of 312 priority projects with investment exceeding USD 8.4 million. Econometric analysis reveals significant correlation (r=0.76, p<0.001) between national transfers and participatory resources, evidencing structural fiscal vulnerability. Three critical success factors are identified: multilevel institutional articulation, accumulated social capital (186 active organizations), and contextualized methodological adaptation. However, structural challenges persist related to fiscal dependency (68% of revenue from transfers), power asymmetries in participation (73% male overrepresentation in leadership), and tensions between economic development and environmental sustainability. Comparative analysis with 15 Latin American experiences positions Cotacachi as a paradigmatic case of institutional innovation, albeit with scalability limitations. The study concludes that the model represents a significant contribution to democratization of subnational public management, requiring structural reforms in fiscal architecture and inclusion mechanisms to ensure sustainability.

Smart Labor Contracts: alcances y limitaciones en el sistema jurídico colombiano

El avance de las nuevas tecnologías y su permeabilidad en las ciencias jurídicas dio origen a una tecnología automatizable denominada “Smart Contracts” o contratos inteligentes, que aplicados al ámbito legal se denominan “Legal Smart Contract”, los cuales obedecen a una tecnología disruptiva de ejecución automática contractual que funciona a base de Blockchain. En la estructura piramidal normativa no existe una fuente formal robusta que, conforme al sistema positivista, garantice un régimen de responsabilidad sólido frente a los riesgos de estas nuevas tecnologías; no obstante, conforme al principio de neutralidad tecnológica es viable su aplicabilidad, atendiendo el deber de garantía que tiene el Estado en el uso de las Tic’s, empero, en materia laboral no hay consenso sobre su uso, en atención a los perjuicios que estas pueden causar en las relaciones laborales. Por lo anterior, este artículo realiza un análisis de esta nueva tecnología contractual, así como de los contratos laborales, con el objetivo principal de determinar los argumentos normativos que sustenten la aplicabilidad, alcances y limitaciones de esta tecnología disruptiva en los contratos laborales. Lo anterior, se desarrolló a partir de la dogmática y hermenéutica jurídica, con un enfoque cualitativo, aplicando métodos de interpretación como el exegético y sistemático, para abordar el tema objeto de investigación, mediante la revisión documental según la doctrina y la jurisprudencia en Colombia. Finalmente, esta investigación concluye en que los contratos laborales no pueden ser ejecutados por Legal Smart Contracts, atendiendo la imposibilidad de autoejecutabilidad de los requisitos requeridos por el Código Sustantivo del Trabajo, el objeto del derecho laboral y el poder dominante del empleador en la relación laboral.

Revision y propuesta de unificacion de los informes macrofiscales para fortalecer la gestion fiscal territorial

Objective: To characterize the preparation of macro-fiscal reports on the Budget, the Treasury and the State of Public Finances submitted by territorial comptrollers’ offices in Colombia. Methodology: With a simple random sampling study, a sample size of 34 comptrollers’ offices was determined. The Tool to characterize macro-fiscal reports in light of the Territorial Audit Guide (GAT) was designed and applied. Results: Budget and Treasury reports predominate, and in the case of the comptrollers’ offices that prepare both types of reports, the Public Finance reports contain the Budget and Treasury reports. With respect to departmental comptrollers’ offices, few manage to consolidate information from municipalities and decentralized entities. Conclusions: unifying the two types of macro-fiscal reports in order to improve the quality and comparability of the information generated by the territorial comptrollers’ offices. This would provide a complete view of the fiscal situation of territorial entities, facilitating fiscal control and informed decision making.

Retos de los contratos inteligentes en la gobernanza de las organizaciones autónomas descentralizadas en LATAM

En el contexto de América Latina, se exploran las perspectivas jurídicas que envuelven a los contratos inteligentes y su influencia en la gobernanza de las Organizaciones Autónomas Descentralizadas (DAO). Los objetivos primordiales de esta investigación incluyen la definición precisa de las DAO y los contratos inteligentes, el análisis exhaustivo de sus ventajas y desafíos en la gobernanza de las DAO, la exploración del estado actual del marco legal en la región, la identificación de los retos legales latentes y la propuesta de soluciones viables. La metodología se basa en una revisión bibliográfica minuciosa y un análisis detallado de las regulaciones vigentes. Los resultados destacan avances legislativos significativos, pero también ponen de manifiesto lagunas jurídicas relacionadas con la jurisdicción y la privacidad. En última instancia, se enfatiza la imperante necesidad de implementar regulaciones adaptables y estándares internacionales para fomentar la adopción segura de las tecnologías blockchain y los contratos inteligentes en la región latinoamericana. This article examines the legal perspectives of smart contracts in the governance of decentralized autonomous organizations (DAOs) in Latin America. The main objectives include defining DAOs and smart contracts, analyzing their benefits and challenges in DAO governance, exploring the current legal framework in the region, identifying challenges, and proposing solutions. The methodology used consists of literature review and documentary analysis of existing regulations. The results highlight advancements in legislation but also legal gaps regarding jurisdiction and privacy. In conclusion, the need for adaptive regulations and international standards to promote the secure adoption of blockchain technologies and smart contracts in Latin America is emphasized.

Eficacia de la implementación de los NTF's como medio de notificación judicial en procesos de arbitraje

Ante la irrupción de las Tecnologías de la Información y Comunicación (TIC’S) en las labores que realizan las personas de forma cotidiana, se ha visto la necesidad de ir generando normas que permitan adaptar estas nuevas dinámicas en el funcionamiento de la sociedad. Así, países como Colombia en los últimos años han puesto en marcha la implementación de normas que han impulsado el uso de estas herramientas digitales en los diferentes escenarios jurídicos, tales como los procesos judiciales. Es por ello que el objetivo principal del presente artículo es identificar la viabilidad y eficacia de la implementación de los NFT´'s (Non-Fungible Tokens) como medio de notificación judicial en procesos de arbitraje en Colombia, los cuales permiten llevar a cabo un seguimiento para que la notificación pueda llegar apropiadamente a los correos electrónicos de las partes, teniendo la certeza de que han sido recibidos por el respectivo destinatario, de forma segura, eficaz y descentralizada.

Ha sido la doctrina administrativa la que ha ofrecido transitoriamente una línea argumental, más o menos evolucionada, en algunos aspectos, aunque insuficientes en otros, sobre su régimen tributario, integrando esta nueva realidad virtual en las categorías jurídicas clásicas previstas por nuestro ordenamiento tributario.

Basic principles of local public administration in the context of the decentralized administrative system

The decentralized administrative system presupposes the existence, along with the national community, of territorial communities (local and regional), which is one of the main foundations of any democratic regime. Their efficient organization and functioning is directly dependent on the correct theoretical substantiation and the adequate transposition through the fundamental laws and the relevant normative framework of the basic principles regarding the local public administration. Doctrinal, but also according to advanced administrative practices, decentralization and local autonomy are the fundamental concepts that regulate the organization and functioning of decentralized communities / local public administration. In this sense, for the modernization of the local administration, it is necessary to ensure the adequate transposition of the principles of decentralization and local autonomy through the prism of the identification in the matter of administrative independence, the application of some fundamental financings.

Papel de la administración pública en la relación público-privado

Among the main transformations made by the Cuban Government in line with the improvement of the Economic and Social Model is the opening of the self-employed sector, as a form of decentralization of state activity and new employment options. This work reflects on the challenges that public administration must face in a public-private partnership in Cuba. The available documentation was reviewed and the aspects analyzed in the Public-Private Seminar in Cuba (July 2018) were considered. This analysis allowed to clarify important conceptualizations of the role of the public administration before the public-private partnership and the radical changes reflected in the decentralization, the stimuli to the financing of the local development, the development of the Port of Mariel and the tourism. Under these conditions, three actors are of great importance in the country: cooperatives, self-employed workers and companies, which can contribute significantly to the country's development objectives, where the Cuban public administration plays an essential role and it demands more and more its strengthening, preparation and modernization as an institution, to face the challenges and goals proposed. The association and / or private public relation is a reality and a necessity to promote a sustainable development in Cuba, where under the leadership of the public administration the strategic objectives of the medium and long term are met and the social welfare is raised.

Una aplicación jurídica del "Blockchain": los "smart contracts"

espanolAl igual que el Internet de la Informacion ha configurado ya la vida social y economica, el «nuevo Internet del Valor», construido sobre la nueva estructura del «Blockchain» y los contratos inteligentes, pasara a formar parte de la actividad de las personas, empresas y Administraciones Publicas. En este estudio se analiza el concepto y la realidad de la denominada «cadena de bloques» o Blockchain, asi como su funcionamiento, con particular atencion a la descripcion general de la operativa del Blockchain, para comprender mejor sus diversas implicaciones y el modo en que afecta e interesa a las personas y entidades. Uno de los ambitos en que el Blockchain ha despertado considerable interes es el legal. Por ello, entre las diversas aplicaciones juridicas del Blockchain, los «smart contracts» merecen un analisis mas detallado, a partir de su propio concepto y mediante la comprension de la evolucion de la contratacion tradicional a la «inteligente». En este sentido, resulta elocuente abordar el funcionamiento de tales «smart contracts», para seguidamente valorar sus funciones adicionales, los diversos usos ya actuales y posibles de los contratos inteligentes, asi como los beneficios inherentes este nuevo modo de comprender la contratacion inteligente. A nuestro juicio, los «smart contracts» de gran potencial para el sector privado poseen mayores repercusiones e implicaciones legales en la Administracion Publica, con una progresiva sustitucion y mejora de los procedimientos tradicionales por procedimientos inteligentes, con la innovacion y eficiencia, ademas del amplio beneficio, que ello podria comportar en general. Asimismo, en aquellos espacios juridicos en los que la comunicacion y relacion legal entre dos o mas partes, ya sean personas fisicas vivas o maquinas, los contratos inteligentes podran mejorar y potenciar mayor veracidad, seguridad, rapidez y reduccion de costes temporales y economicos, con las indudables ventajas que ello comportaria para particulares como empresas y Administraciones publicas. EnglishJust as the Internet of Information has already shaped social and economic life, the «new Internet of Value», built on the new «Blockchain» structure and intelligent contracts, will become part of the activity of people, companies and Public Administrations . This study analyzes the concept and reality of the so-called Block-chain, as well as its operation, with particular attention to the general description of Blockchain operations, in order to better understand its various implications and the way in which it affects the It interests people and entities. One of the areas in which the Blockchain has aroused considerable interest is the legal one. Therefore, among the various legal applications of Blockchain, smart contracts deserve a more detailed analysis, based on their own concept and by understanding the evolution of traditional to «intelligent contracting». In this sense, it is eloquent to address the operation of such smart contracts, to then assess their additional functions, the various current and possible uses of smart contracts, as well as the inherent benefits of this new way of understanding intelligent contracting. In our opinion, the «smart contracts» of great potential for the private sector have greater repercussions and legal implications in the Public Administration, with a progressive substitution and improvement of the traditional procedures by intelligent procedures, with innovation and efficiency, in addition to the wide benefit, that this could behave in general. Likewise, in those legal spaces in which the communication and legal relationship between two or more parties, whether they are living physical persons or machines, intelligent contracts can improve and enhance greater veracity, safety, speed and reduction of temporary and economic costs, with the undoubted advantages that this would entail for individuals such as companies and public administrations.

ResumenLa tesis que se defiende en este trabajo es que el complejo modelo institucional y territorial vasco funciona aceptablemente bien, a pesar de sus luces y sombras, y puede ser un ejemplo de la idea ampliamente generalizada de cómo un modelo de organización territorial descentralizada (y sus complejas, pero al mismo tiempo, valiosas formas de interacción entre los distintos niveles de gobierno), pueden mejorar la calidad del gobierno de sus instituciones, ayudar en el desarrollo humano, económico y social, aumentar la transparencia, administrar los recursos disponibles para ofrecer mejores servicios públicos y, en definitiva, mejorar la calidad democrática de la sociedad.Summary1. Un acercamiento metodológico al desarrollo local desde la demografía

Se realiza un análisis de los componentes esenciales del proceso de gestión del desarrollo local, que han de constituirse en principios para la gestión del mismo. Se proponen cuatro principios para la gestión del desarrollo local, a saber: la descentralización, la financiación, la objetividad de la gestión y la participación. El proceso de desarrollo local no es posible al margen de la descentralización, para lo cual se necesita la definición de competencias de gestión local, comprendidas en su doble perspectiva, a saber, en sus componentes normativo y cognitivo. La financiación garantiza la autonomía para la gestión local. Para poder gestionar el desarrollo local se hace necesario poder tener una representación de la situación demográfica del territorio, pero para ello hace falta hacer una caracterización que identifique la situación real del territorio. Ello garantiza la objetividad en el proceso de gestión. Se presenta un algoritmo cuyos componentes constituyen pasos necesarios a cumplir para la instrumentación de indicadores sociodemográficos para la elaboración de las estrategias de desarrollo local. En la participación como principio, hay que tener en cuenta dos componentes ineludibles del mismo, a saber: la información-comunicación y la informatización, en el contexto del entramado institucional que le da cobertura a esa participación y los procedimientos para bregar con sus contenidos y evaluar su efecto. La información-comunicación garantiza el contenido de la participación mientras que la informatización es lo que garantiza la universalidad del acceso a la información como base para la participación social en el desarrollo local. An analysis is made of the essential components of the local development managing process, which are to be principles for managing local development. Those as principles for the management of local development are identified. And are proposed four principles for the management of local development, namely: decentralization, financing, management objectivity and participation. The process of local development is not possible taking it into apart the decentralization, necessary to define competences included from a dual perspective, namely in its normative and cognitive components. Financing is critical for local management autonomy. In order to manage local development, it is necessary a representation of territorial demographic situation, that`s why it is also necessary a characterization to identify the real demographic situation of the territory. This guarantees objectivity in the management process. An algorithm whose components are necessary steps to be followed for the instrumentation of sociodemographic indicators for local development strategies elaboration is presented. In participation principle, it is necessary to take into account two inescapable components of the same, namely: information-communication and computerization. Information-communication guarantees the content of participation while computerization is guarantees for the universal access to information as basis for social participation in local development.

La organización territorial de España. Una reflexión sobre el estado de la cuestión y claves para la reforma constitucional

Resumen:En este trabajo se reflexiona con amplia perspectiva histórica sobre la cuestiónde la organización territorial del Estado en España hasta desembocar en la situación actual y ofrecer, a la luz de esa evolución, algunas claves para la reforma constitucional en sentido federal que se entiende necesaria en nuestros días. Partiendo de la evidencia de que la respuesta ofrecida por el constitucionalismo histórico español ante la forma territorial del Estado ha sido, como tónica general, la de configurar a España como un Estado unitario, centralizado, simbolizado por la Monarquía, se analizan sumariamente los dosgrandes intentos de distinto signo que existieron antes de la Constitución de 1978 para salir del unitarismo y poner en pie modelos de descentralizaciónpolítica. La primera experiencia, de cuño federal, gestada durante la Primera República (1873-1874) se consumió en unos meses sin que pudiera discutirse siquiera el Proyecto de Constitución Federal de 1873, elaborado en el marco de una situación política y social extremadamente convulsa que desembocó en la anarquía del cantonalismo. La segunda, que durante el quinquenio de la Segunda República (1931-1936) ensayó la compatibilidad de un llamado «Estado integral» con la autonomía de las regiones, fue llevada muy parcialmente a la práctica y acabó con la sublevación militar encabezada por el general Franco y la guerra civil (1936-1939).Tras el franquismo y la Transición democrática, la Constitución de 1978 no constitucionalizó un modelo preciso y acabado de descentralización políticasino que prefiguró un Estado «descentralizable», abierto a distintas posibilidades, dando curso a un «proceso autonómico» a partir del reconocimiento del derecho a la autonomía de las nacionalidades y regiones en su Título Preliminar y el establecimiento de complejas reglas en el Título VIII. La apertura de este proceso fue evolucionando hacia el llamado «Estado autonómico» mediante la práctica política y la doctrina del Tribunal Constitucional, desarrollándose paulatinamente con las técnicas del federalismo y en su campo de atracción hasta configurar un Estado federal en los hechos, aunque con notorias carencias e incoherencias de estructura y funcionamiento. El estado autonómico entró en crisis a partir, sobre todo, de los embates del nacionalismo político en el País Vasco a comienzos de la década de 2000 y especialmente en Cataluña desde mitad de la década pasada hasta la actualidad, momento álgido del desafío secesionista. A lo largo del trabajo se intenta mostrar primero que si bien en 1873, 1931 y 1978 hubo un rotundo rechazo del centralismo y una aspiración indubitada al establecimiento de la autonomía regional bajo distintas formas, no pudo fraguarse en ninguno de estos momentos, por diferentes razones, una neta voluntad constituyente en esta materia que estuviera en condiciones de sostener eficazmente un modelo definido. Se considera que por esta y otras causas la cuestión territorial sigue estando recurrentemente abierta en canal, a la espera de una constitucionalización adecuada que permita vertebrar con la estabilidad necesaria el Estado español. Tras un diagnóstico general del modelo autonómico en su evolución en la órbita del federalismo, se abordan, de acuerdo con este planteamiento, los elementos centrales que se consideran necesarios para una reforma constitucional en clave federal que racionalice un Estado que ya es federal en los hechos y que permita integrar todos los territorios con sus singularidades, dedicando una especial atención a la cuestión catalana en el marco del actual desafío independentista.Abstract:In this work we reflect from a broad historical perspective on the question of the territorial organization of the State in Spain leading to the current situation and offer, in light of this evolution, some keys to the constitutional reform in a federal sense that is deemed necessary in our days. Starting from the evidence that the answer offered by the Spanish historical constitutionalism to the territorial shape of the State has been, in general, to configure Spain as a unitary, centralized state, symbolized by the Monarchy, we analyzed the two large and different attempts that existed prior to the 1978 Constitution to emerge from unitarianism and to establish models of political decentralization. The first experience, with a federal character, developed during the First Republic (1873-1874) was consumed in a few months without even being able to discuss the Draft of the Federal Constitution of 1873, elaborated in the context of an extremely convulsive political and social situation that ended in the anarchy of cantonalism. The second, which during the five-year period of the Second Republic (1931-1936) tested the compatibility of a so-called «integral state» with the autonomy of the regions, was taken very partially into practice and ended with the military uprising led by general Franco and the Civil War (1936-1939).After Franco’s regime and the democratic Transition, the Constitution of 1978 did not constitutionalize a precise model of political decentralization but prefigured a «decentralized» State, open to different possibilities, giving way to an «autonomic process» from the recognition of the right to the autonomy of nationalities and regions in their Preliminary Title and the establishment of complex rules in Title VIII. The opening of this process evolved towards the so-called «Autonomous State» through political practice and the doctrine of the Constitutional Court, developing gradually with the techniques of federalism and in its field of attraction until setting up a the facto federal State, although with notorious deficiencies and inconsistencies in structure and functioning. The autonomous state came into crisis starting, above all, from the clashes of political nationalism in the Basque Country in the early 2000s and especially in Catalonia from the middle of the last decade to the present, the height of the secessionist challenge.In the course of this work we try to show that, although in 1873, 1931 and 1978 there was a resounding rejection of centralism and a clear aspiration to establish regional autonomy under different forms, it could not be forged in any of these moments, for different reasons , a net constituent will in this matter that would be able to effectively support a defined model. It is considered that for this and other causes the territorial question is still recurrently open in a channel, pending the appropriate constitutionalization that allows to vertebrate with the necessary stability the Spanish State. Following a general diagnosis of the autonomous model in its evolution in the orbit of federalism, the central elements are considered according to this approach, which are are regarded as necessary for a constitutional reform in a federal key that rationalizes a State that is already federal in the facts and that allows to integrate all the territories with their singularities, devoting a special attention to the Catalan questionwithin the framework of the present independence challenge. Local Autonomy, Territorial Organization and Municipal Segregation

The Law 5/2010 of Local Autonomy of Andalusia deepens in the capacities of the municipalities to decide on themselves: the procedures of segregation of municipal terms need express conformity of the absolute majority of the plenary session of the local government of the municipality that suffers the segregation. On the other hand, the municipalities have the possibility of spatially organizing their municipal area, or part of it, in territorial districts as a manifestation of their full political autonomy, and may be of a deconcentrated nature (hamlets, parishes, villages, neighborhoods, churches, councils, districts, adjoining and other analogous places) or decentralized (Autonomous Local Entities or Neighborhood Entities). As for the Autonomous Local Entities conformed in Andalusia, they are usually a previous step to the creation of a new municipality, for which the Law 27/2013, of Rationalization and Sustainability of the Local Administration has established a population limit that, in the practice, suppresses segregationist aspirations.

Naturaleza Jurídica del Estado Federal descentralizado como organización político-territorial en Venezuela

The main objective of this investigation was to analyze the legal nature of the Decentralized Federal State as a political-territorial organization in Venezuela. The federal State is formed under the principles of federalism, that is, of political decentralization. Its territory is divided into autonomous units that, on certain matters, are governed by their own Constitution, laws and authorities, while others are subject to the central legal order of the State and the government of the federation. It corresponds to the federal Constitution to distribute the competences between the central and decentralized bodies. The methodology was based on a non-experimental design, in the documentary research modality. The techniques of documentary observation, analytical summary and critical examination, bibliographies of national and foreign authors were used; the Constitution of the Bolivarian Republic of Venezuela (1999) and the Organic Law of People's Power (2010). The techniques of data collection will be the bibliographic archival and the documentary observation, whose instrument will be the documentary record.

Gasto público, medios personales y funcionamiento de la Administración de Justicia en España: ¿el problema es el gasto?

espanolEl funcionamiento de la Administracion de Justicia en Espana es actualmente muy cuestionado. Muchos profesionales de la justicia sostienen que esta es la Cenicienta de las administraciones y que es la carencia de medios la causa que justificaria el mal funcionamiento, solicitando, por ello, mayor gasto como medio preferente para mejorarlo. Para conocer si esta afirmacion se puede sustentar cientificamente, hemos analizado 3 indicadores troncales (gasto publico, medios personales a su servicio y funcionamiento del sistema judicial) tanto a nivel nacional como de las Comunidades Autonomas, porque debe tenerse en cuenta que la organizacion de la Administracion de Justicia en Espana esta desconcentrada y descentralizada, lo que condiciona su gestion. EnglishThe functioning of the administration of Spanish justice is being increasingly questioned. Many legal practitioners think that is the Cinderella of the Public Administration and that is the lack of financial resources the reason of its bad malfunctions. In order of to know if these affirmations have scientific basis we have analyzed three focus indicators (public spending, justice personal resource, judicial system operation) both national level as autonomous communities level, because it have to be take in a count that the administration organization of justice in Spain is decentralized and deconcentrated, and these reasons affect their management.

HACIA UNA ADMINISTRACIÓN DESCENTRALIZADA PARA LA DEFENSA DE LA COMPETENCIA EN ESPAÑA

Con ocasión de la promulgación de la Ley 15/2007, de 3 de julio, de defensa de la competencia, analizaremos los avances realizados en el proceso de descentralización iniciado en 1999. En noviembre de ese mismo año, coincidiendo con la fase final de la tramitación de la Ley 52/1999, de 28.12.1999, que reformó la Ley 16/1989, de defensa de la competencia, el Tribunal Constitucional dictó una sentencia en la que reconocía las competencias ejecutivas de las Comunidades Autónomas en materia de defensa de la competencia. Ello obligó al Gobierno a promover la elaboración de la Ley 1/2002, de 21 de febrero, de coordinación de las competencias del Estado y las Comunidades Autónomas en materia de defensa de la competencia. Posteriormente, en 2007, se llevó a cabo una importante reforma con la Ley 15/2007, de 3 de julio, de defensa de la competencia. En este artículo se analiza el proceso de descentralización y, en especial, el nuevo modelo de organización administrativa aprobado en España para la defensa de la competencia. Urte horretan bertan, azaroan, 52/1999 Legea, urte bereko abenduaren 28koa, izapidetzeko azken pausoak ematen ari zirela (16/1989 legea eraldatu zuen), Konstituzio Auzitegiak emandako epai batean adierazi zuen autonomia-erkidegoek bazituztela lehiaren defentsaren arloko eskumen betearazleak. Epai horren ondorioz, Espainiako Gobernuak Lehia Babesteko Eskumenak Estatuaren eta Autonomia-erkidegoen Artean Koordinatzeko otsailaren 21eko 1/2002 Legea argitaratu behar izan zuen. Horren ostean, 2007an, Lehia Defendatzeko uztailaren 3ko 15/2007 Legearen bidez, erreforma garrantzitsua egin zen. Artikuluan deszentralizazio-prozesua aztertzen da, eta bereziki, Espainian lehia defendatzeko onartutako administrazio-eredua. This study takes advantage of the fact that Competition Act 15/2007, of 3rd July, has been passed to analyse the progress made in the process of decentralization started in 1999. In November of that year, as Act 52/1999 of 28th December 1999, which modified the Competition Act 16/1989, was going through the final procedural stages, the Spanish Constitutional Court announced a decision allowing the Autonomous Communities (Autonomous Regions) to exercise executive competences in protection of competition. This decision forced the government to draw up a law to co-ordinate the duties between the central administrative bodies and the newly-created autonomous bodies: the Act 1/2002 of 21st February, regarding Coordination of the State and Autonomous Communities¿ Competences on Competition Defence. Subsequently, in 2007, it has been an important amendment and Competition Act 15/2007 has been enacted. This article will analyse the process of decentralization and the model of administrative organization that has recently been approved in Spain for protection of competition.
