This article analyzes the implementation of participatory budgeting as a democratic governance mechanism in the Decentralized Autonomous Municipal Government of Santa Ana de Cotacachi, Ecuador, during 2015-2020. Through a mixed methodological approach combining systematic documentary analysis of 147 official documents, 42 semi-structured interviews, participant observation in 12 deliberative sessions, and statistical analysis of management indicators, the institutionalization of the Cantonal Participation System and its multidimensional impact on local public management is examined. Results show that normative formalization through the 2016 Ordinance consolidated a two-decade participatory process, achieving mobilization of 8,347 unique citizens (21.3% of adult population) and execution of 312 priority projects with investment exceeding USD 8.4 million. Econometric analysis reveals significant correlation (r=0.76, p<0.001) between national transfers and participatory resources, evidencing structural fiscal vulnerability. Three critical success factors are identified: multilevel institutional articulation, accumulated social capital (186 active organizations), and contextualized methodological adaptation. However, structural challenges persist related to fiscal dependency (68% of revenue from transfers), power asymmetries in participation (73% male overrepresentation in leadership), and tensions between economic development and environmental sustainability. Comparative analysis with 15 Latin American experiences positions Cotacachi as a paradigmatic case of institutional innovation, albeit with scalability limitations. The study concludes that the model represents a significant contribution to democratization of subnational public management, requiring structural reforms in fiscal architecture and inclusion mechanisms to ensure sustainability.

ICTs have influenced the contract from different angles. One of them is in their enforcement, by implementing a new way of executing them through so-called smart contracts. Their most common use is found in the trading of cryptocurrencies and tokens such as NFTs. This technology consists of a computer program that enables automatic contract execution. However, they raise the issue of their validity, which must be resolved based on the category of contract to which it applies. Their implementation affects the duty of information, and must ensure consumer's right to revoke acceptance, provided for in consumer legislation.

Non-fungible tokens (NFTs) have gained significant prominence in the crypto-asset market in recent years, with their use expanding across a wide range of economic sectors, which in turn raises numerous new tax challenges. This chapter analyzes the main controversial issues that NFTs raise in the area of indirect taxation and the challenges faced by lawmakers and tax authorities.

Objective: To characterize the preparation of macro-fiscal reports on the Budget, the Treasury and the State of Public Finances submitted by territorial comptrollers’ offices in Colombia. Methodology: With a simple random sampling study, a sample size of 34 comptrollers’ offices was determined. The Tool to characterize macro-fiscal reports in light of the Territorial Audit Guide (GAT) was designed and applied. Results: Budget and Treasury reports predominate, and in the case of the comptrollers’ offices that prepare both types of reports, the Public Finance reports contain the Budget and Treasury reports. With respect to departmental comptrollers’ offices, few manage to consolidate information from municipalities and decentralized entities. Conclusions: unifying the two types of macro-fiscal reports in order to improve the quality and comparability of the information generated by the territorial comptrollers’ offices. This would provide a complete view of the fiscal situation of territorial entities, facilitating fiscal control and informed decision making.

En el contexto de América Latina, se exploran las perspectivas jurídicas que envuelven a los contratos inteligentes y su influencia en la gobernanza de las Organizaciones Autónomas Descentralizadas (DAO). Los objetivos primordiales de esta investigación incluyen la definición precisa de las DAO y los contratos inteligentes, el análisis exhaustivo de sus ventajas y desafíos en la gobernanza de las DAO, la exploración del estado actual del marco legal en la región, la identificación de los retos legales latentes y la propuesta de soluciones viables. La metodología se basa en una revisión bibliográfica minuciosa y un análisis detallado de las regulaciones vigentes. Los resultados destacan avances legislativos significativos, pero también ponen de manifiesto lagunas jurídicas relacionadas con la jurisdicción y la privacidad. En última instancia, se enfatiza la imperante necesidad de implementar regulaciones adaptables y estándares internacionales para fomentar la adopción segura de las tecnologías blockchain y los contratos inteligentes en la región latinoamericana. This article examines the legal perspectives of smart contracts in the governance of decentralized autonomous organizations (DAOs) in Latin America. The main objectives include defining DAOs and smart contracts, analyzing their benefits and challenges in DAO governance, exploring the current legal framework in the region, identifying challenges, and proposing solutions. The methodology used consists of literature review and documentary analysis of existing regulations. The results highlight advancements in legislation but also legal gaps regarding jurisdiction and privacy. In conclusion, the need for adaptive regulations and international standards to promote the secure adoption of blockchain technologies and smart contracts in Latin America is emphasized.

Este proyecto se ha centrado en el origen, evolución, historia, características y clasificaciones, ventajas y desventajas, aspectos y conceptos jurídicos y, por último, en la tributación de las criptomonedas o divisas virtuales. El principal objetivo de este proyecto se ha centrado en analizar y observar todos los temas mencionados anteriormente. Para ello se han analizado una serie de proyectos y noticias relacionados con todos estos ámbitos. Como podremos ver según se avance en el contenido del trabajo, las criptomonedas he tenido una importante evolución gracias al aumento tecnológico y a el mayor conocimiento que ha adquirido la población sobre ellas. En temas jurídicos, conocemos que no existe una regulación exacta con las criptomonedas, sin embargo, aunque estas monedas virtuales estén usadas en su mayoría con intenciones especulativas por parte de los individuos, está claro que son un medio de pago puros y como perfectos sustitutos de las monedas tradicionales de cada país. Por último, centrándonos en el tema de la tributación de las divisas virtuales, entendemos que la tributación puede definirse como al acto de pagar tributos y obligaciones contraídas, así como al marco jurídico al que están sujetos los contribuyentes en una nación en lo referente a sus deberes con la entidad recaudadora. El objetivo principal que tiene la tributación es brindar los servicios básicos a la población. Como se explica posteriormente cada vez existe una mayor numero de implicaciones tributarias en las transacciones que se realizan con criptomonedas, por ejemplo, el trading de las criptomonedas podría estar sujetos a IVA al considerarlos similares a loa venta de bienes muebles. Sin embargo, existen numerosos problemas con la tributación de las criptomonedas ya que el sistema no está adaptado a estas nuevas tecnologías. También se ha creado un reglamento (MiCA) que pretende asegurar la regulación de estas divisas virtuales.

[SPA] El objetivo perseguido con este trabajo fin de grado pretende abordar y analizar el tema del control tributario de las criptomonedas intentando así esclarecer y dar un poco de visibilidad sobre este tema. En los últimos años ha crecido de manera exponencial, atrayendo así la atención de inversores, reguladores y autoridades fiscales. Los dos primeros puntos del trabajo los usaré de forma introductoria para así poder tratar conceptos básicos para así poder sumergirnos de la manera más optima en el mundo del control tributario y de las criptomonedas, explicándose temas como: qué es y el por qué de la importancia del control tributario, que es una criptomoneda, bitcoin y un Exchange. Seguido del tema del control y vigilancia tributaria en España hablando así de las limitaciones que esté presenta seguido del sistema y organismos que se encargan de este control tributario continuando con una breve mención sobre la ley MICA. Los siguientes tres puntos son la parte más densa e importante del trabajo tratando temas muy relevantes como: la tributación fiscal de diversos impuestos adaptados a la posesión de criptomonedas, seguido de las obligaciones de los contribuyentes donde se mencionaran algunos de los nuevos modelos fiscales junto a las sanciones que estos usuarios poseedores de criptomonedas pueden llegar a tener si no cumplen correctamente sus obligaciones fiscales, y finalmente de los retos y desafíos del control tributario, que consistirá en una breve mención del por qué de la importancia actual de las criptomonedas junto a los problemas que estas causan en la actualidad. Finalmente llegamos al punto de la conclusión en el que se expondrá y reflexionará sobre todo lo aprendido a lo largo de la investigación de este Trabajo Fin de Grado junto a posibles escenarios futuros del desarrollo de la fiscalidad de las criptomonedas. [ENG] The aim of this final degree project is to address and analyse the issue of the tax control of cryptocurrencies in an attempt to clarify and give some visibility to this topic, as it is a very current issue, but at the same time quite unknown. In recent years it has experienced exponential growth, attracting the attention of investors, regulators and tax authorities. I will use the first two points of the paper as an introduction to deal with basic concepts in order to immerse ourselves in the most optimal way in the world of tax control and cryptocurrencies, explaining topics such as: what is tax control and why is it important, what is a cryptocurrency, bitcoin and an exchange. Followed by the topic of tax control and surveillance in Spain and the limitations that this presents followed by the system and agencies that are responsible for this tax control followed by a brief mention of the MICA law. The next three points are the most dense and important part of the work, dealing with very relevant issues such as the taxation of various taxes adapted to the possession of cryptocurrencies, followed by the obligations of taxpayers where some of the new tax models will be mentioned along with the penalties that these users holding cryptocurrencies may face if they do not comply correctly with their tax obligations, followed finally by the challenges and challenges of tax control, which will consist of a brief mention of why the current importance of cryptocurrencies together with the problems that they cause at present. Finally, we come to the point of the conclusions in which we will present and reflect on everything we have learned throughout the research of this Final Degree Project together with possible future scenarios for the development of the taxation of cryptocurrencies.

Tras más de una década de la aparición en el mercado de la primera moneda virtual no hay todavía una regulación legal sobre el régimen tributario de las operaciones de creación, posesión, adquisición y transmisión del bitocoin. Ha sido la doctrina administrativa la que ha ofrecido transitoriamente una línea argumental, más o menos evolucionada, en algunos aspectos, aunque insuficientes en otros, sobre su régimen tributario, integrando esta nueva realidad virtual en las categorías jurídicas clásicas previstas por nuestro ordenamiento tributario.

La aparición, consolidación y diversidad de las criptomonedas hace necesario que la disciplina contable tome nota rápida del fenómeno y dé respuestas sobre su incorporación al patrimonio, su medición y exposición. Los riesgos y la volatilidad son características particulares de este tema.

En los años 90 surge una nueva forma de hacer democracia, donde la representación social toma fuerza; la ciudadanía participa en la formulación de políticas públicas y en la priorización de los proyectos a desarrollarse, dentro del presupuesto anual de su localidad, metodología conocida como Presupuesto Participativo (PP). Esta tesis doctoral presenta como objetivo: generar un marco de implementación y monitoreo del PP que pueda aplicarse en zonas rurales, caracterizadas por el aislamiento y la falta de una cultura de participación asentada, con el fin de incentivar su implementación, en la búsqueda de mejorar las condiciones de vida de la ciudadanía, promover una mayor eficacia del gobierno local, como medio para el fortalecimiento de la gobernabilidad y democracia. Para dar cumplimiento al objetivo, mencionado en el párrafo anterior, la investigación desarrollada se presenta en varios capítulos: El capítulo II, se enfoca en la revisión bibliográfica sistemática de las publicaciones, respecto al PP, indexadas en Web of Science, Scopus y Redalyc. Con el propósito de determinar la tendencia de la literatura referente al PP. Los resultados muestran a Porto Alegre, en Brasil, como la zona de mayor aplicación de la metodología, y a la voluntad política como el principal factor de éxito para el proceso. En el capítulo III, se analiza con un enfoque cualitativo, el marco legal del Ecuador, para determinar si se ofrecen los incentivos, espacios y herramientas necesarios para la aplicación del PP. Este análisis identifica a los Gobiernos Autónomos Descentralizados (GAD) Municipales como el nivel al que se debe aplicar el PP, según lo señalado por el Código Orgánico de Organización Territorial, Autonomía y Descentralización (2008) en el artículo 100: la participación ciudadana se ejercerá para elaborar presupuestos participativos de los gobiernos municipales. Por tanto, el análisis del marco legal a este nivel muestra que sí existe una inclusión del PP en la normativa ecuatoriana, especialmente en lo relacionado a bases y principios, sin embargo, aún no se ven plasmadas en la ley propuestas específicas para su aplicación. Entre estas deficiencias se observa la inexistencia de una fórmula oficial para la determinación del monto o porcentaje que los GAD Municipales deben destinar al PP. El objetivo principal de esta tesis se desarrolla en el capítulo IV, donde se genera el marco de implementación y monitoreo del PP, el cual es diseñado con base en las investigaciones existentes en la materia. Este marco de implementación y monitoreo es validado en dos momentos. En el capítulo IV, como primer momento de validación, este marco se compara con la aplicación de GAD Municipal de Gualaquiza, zona caracterizada por el aislamiento y la falta de una cultura de participación asentada, para establecer si el modelo funciona, sus factores de éxito y limitantes. En un segundo momento, en el capítulo V, se realiza una evaluación de la aplicación del GAD Municipal de Gualaquiza, para determinar elementos adicionales que refuercen o maticen al marco establecido tras la primera validación. En el capítulo VI se presenta el modelo definitivo luego de los dos momentos de validación. La aplicación de los capítulos IV y V, se realiza al GAD Municipal de Gualaquiza, ubicado en una zona rural de la Amazonía del Ecuador, zona caracterizada por no tener mayor experiencia de la aplicación del PP, debido a que sus autoridades no aplican la metodología de forma consecutiva y no se genera un conocimiento comunitario. Además, es una ruralidad caracterizada por el aislamiento, ya que las comunidades se encuentran alejadas geográficamente, donde sus pobladores realizan sus labores en zonas de difícil acceso, y donde estas situaciones se ven agravadas por una estructura vial y de comunicaciones que aporta a una escasa o nula conectividad (Vasco, 2016). La población de esta zona se dedica mayoritariamente a la agricultura y ganadería; el 32,3% usa leña como combustible para cocinar; solo el 43,8% de la población tiene alcantarillado, y el 69,7% de la población llega a un nivel de instrucción de primaria (INEC, 2001). El capítulo IV, señala que el marco de implementación y monitoreo del PP, el cual es diseñado con base en las investigaciones existentes en la materia, es viable, una vez corregida la dificultad de cumplir con el número ideal de asambleas ciudadanas para la determinación y priorización de obras. Cabe destacar que en Ecuador se conocen como obras a los proyectos que presentan productos físicos tangibles y que son desarrollados por las entidades de gobierno local o central. La priorización, en la mayoría de las ocasiones, no se realiza debido a la ruralidad de las comunidades, estas se encuentran alejadas geográficamente, y la estructura vial y de comunicaciones aporta a una escasa o nula conectividad (Vasco, 2016). El capítulo IV presenta como factores de éxito: el fomento de una educación participativa, nivel de motivación de los ciudadanos, calidad de las convocatorias a asambleas ciudadanas de forma que se alcance representatividad, capacidad de respuesta de los GAD Municipales, y; como limitantes: voluntad política de las autoridades municipales, falta de continuidad en el proceso, procesos burocráticos, escasa experiencia participativa, distancia geográfica entre comunidades. El capítulo V, realiza una evaluación de la aplicación del GAD Municipal de Gualaquiza, zona caracterizada por el aislamiento y la falta de una cultura de participación asentada. Esta evaluación, corresponde al segundo momento de validación del marco de implementación y monitoreo del PP, se enfoca en tres aspectos fundamentales: 1) evaluación de la ejecución a través de los indicadores de eficacia y eficiencia en los años 2017 y 2018; 2) medición de la percepción y satisfacción ciudadana, a través de la aplicación de encuestas a una muestra de la población del GAD Municipal de Gualaquiza; 3) evaluación del cumplimiento de los principios de participación ciudadana, recogidos de la Constitución de la República del Ecuador y COOTAD. En toda la tesis, la referencia a ciudadanía se realiza bajo la concepción de persona como miembro activo de un Estado y titular de derechos políticos y sometido a su vez a sus leyes. En este capítulo se reconocen como elementos adicionales al marco de implementación y monitoreo validado en un primer momento, la importancia de ejecutar todo el proceso de implementación del PP con base en los principios de participación ciudadana, se resalta la importancia de un monitoreo continuo entre técnicos municipales y representantes de las comunidades, y establecer un sistema de comunicación como un mecanismo de transparencia. El capítulo VI, la tesis ofrece como resultado final un proceso sistematizado de las fases de implementación y monitoreo del PP para zonas rurales caracterizadas por el aislamiento y la falta de una cultura de participación asentada, una vez que se ha validado con la aplicación del GAD Municipal de Gualaquiza en los dos momentos señalados anteriormente. Este producto es relevante tras observar que las guías disponibles para la implementación del PP son variadas, dependiendo de los autores y de las particularidades de las zonas estudiadas, pero que no se han diseñado para ser aplicadas en zonas rurales caracterizadas por el aislamiento y la falta de una cultura de participación asentada. ----------ABSTRACT---------- In the 90s, a new way of making democracy emerged, where social representation took hold; Citizens participate in the formulation of public policies and in the prioritization of projects to be developed, within the annual budget of their locality, a methodology known as Participatory Budgeting (PB). This doctoral thesis presents as an objective: to generate a framework for the implementation and monitoring of the PB that can be applied in rural areas, characterized by isolation and the lack of a culture of established participation, to encourage its implementation, in the search to improve the living conditions of citizens, promoting greater efficiency in local government, as a means of strengthening governance and democracy. To fulfill the objective, mentioned in the previous paragraph, the research carried out is presented in several chapters: Chapter II focuses on the systematic bibliographic review of the publications, regarding PB, indexed in Web of Science, Scopus and Redalyc. To determine the trend of the literature regarding PB. The results show Porto Alegre, in Brazil, as the area with the greatest application of the methodology, and political will as the main success factor for the process. In chapter III, the legal framework of Ecuador is analyzed with a qualitative approach, to determine if the necessary incentives, spaces, and tools are offered for the application of the PB. This analysis identifies the Municipal Decentralized Autonomous Governments (GAD) as the level at which the PB should be applied, as indicated by the Organic Code of Territorial Organization, Autonomy and Decentralization (2008) in article 100: citizen participation will be exercised to prepare participatory budgets for municipal governments. Therefore, the analysis of the legal framework at this level shows that there is an inclusion of the PB in the Ecuadorian regulations, especially in relation to bases and principles, however, specific proposals for its application are not yet reflected in the law. Among these deficiencies is the non-existence of an official formula for determining the amount or percentage that the Municipal GADs must allocate to the PB. The main objective of this thesis is developed in chapter IV, where the implementation and monitoring framework of the PB is generated, which is designed based on existing research on the matter. This implementation and monitoring framework is validated in two moments. In chapter IV, as a first moment of validation, this framework is compared with the application of the Municipal GAD of Gualaquiza, an area characterized by isolation and the lack of a culture of established participation, to establish if the model works, its success factors and limiting. In a second moment, in chapter V, an evaluation of the application of the Municipal GAD of Gualaquiza is carried out, to determine additional elements that reinforce or qualify the framework established after the first validation. Chapter VI presents the final model after the two validation moments. The application of chapters IV and V is carried out at the Municipal GAD of Gualaquiza, located in a rural area of the Amazon of Ecuador, an area characterized by not having greater experience of the application of the PP, because its authorities do not apply the methodology consecutively and no community knowledge is generated. In addition, it is a rurality characterized by isolation, since the communities are geographically remote, where their inhabitants carry out their work in areas of difficult access, and where these situations are aggravated by a road and communications structure that contributes to a scarce or no connectivity (Vasco, 2016). The population of this area is dedicated mainly to agriculture and livestock; 32.3% use firewood as fuel for cooking; only 43.8% of the population has sewerage, and 69.7% of the population reaches a primary level of education (INEC, 2001). Chapter IV indicates that the implementation and monitoring framework of the PB, which is designed based on existing research on the matter, is viable, once the difficulty of complying with the ideal number of citizen assemblies for the determination and prioritization of works. It should be noted that in Ecuador projects that present tangible physical products and that are developed by local or central government entities are known as works. Prioritization, in most cases, is not carried out due to the rurality of the communities, they are geographically remote, and the road and communications structure contributes to little or no connectivity (Vasco, 2016). Chapter IV presents as success factors: the promotion of participatory education, level of motivation of citizens, quality of calls to citizen assemblies so that representativeness is achieved, response capacity of the Municipal GADs, and as limitations: political will of the municipal authorities, lack of continuity in the process, bureaucratic processes, little participatory experience, geographical distance between communities. Chapter V makes an evaluation of the application of the Municipal GAD of Gualaquiza, an area characterized by isolation and the lack of a culture of established participation. This evaluation, corresponds to the second moment of validation of the implementation and monitoring framework of the PB, focuses on three fundamental aspects: 1) evaluation of the execution through the effectiveness and efficiency indicators in the years 2017 and 2018; 2) measurement of citizen perception and satisfaction, through the application of surveys to a sample of the population of the Gualaquiza Municipal GAD; 3) evaluation of compliance with the principles of citizen participation, collected from the Constitution of the Republic of Ecuador and COOTAD. Throughout the thesis, the reference to citizenship is made under the conception of a person as an active member of a State and holder of political rights and subject in turn to its laws. This chapter recognizes as additional elements to the implementation and monitoring framework validated at first, the importance of executing the entire CP implementation process based on the principles of citizen participation, the importance of continuous monitoring among technicians is highlighted. municipalities and community representatives and establish a communication system as a transparency mechanism. Chapter VI, the thesis offers as a final result a systematized process of the implementation and monitoring phases of the PB for rural areas characterized by isolation and the lack of an established culture of participation, once it has been validated with the application of the GAD Municipal of Gualaquiza in the two moments indicated above. This product is relevant after observing that the guidelines available for the implementation of the PB are varied, depending on the authors and the particularities of the areas studied, but that they have not been designed to be applied in rural areas characterized by isolation and lack of an established culture of participation.

The Spanish Constitution reserved to the central legislative power the competence to establish the minimum fundamental services in health (art. 149.1.16 CE), while the Autonomous Communities are the competent ones for their legislative development and management. During these more than forty years of validity of the constitutional text there has been a progressive decentralization in health management, which would culminate in 2001, along with an important legislative centralization. This competence distribution contrasts with the financing system designed for healthcare provision since 2001. A system in which the weight of the responsibility for spending rests primarily with the Autonomous Communities. This paper analyzes the competency distribution in Spain in health matters and relates it to the financing system designed, showing the inconsistency that exists in this regard in the design of health care.

The boom of cryptocurrencies as a mechanism of payment and investment&nbsp;has reached Peru, but our country lacks a legal regulation regarding the legal and&nbsp;fiscal consequences of operations with Bitcoins or other kinds of cryptocurrencies. In&nbsp;this article, the author elaborates a legal-fiscal analysis applicable to Bitcoin-related&nbsp;operations in Peru: mining, exchanges for goods and services, and exchanges for other&nbsp;kinds of currency. The first part of this article questions the legal nature of criptocurrencies&nbsp;based on the Peruvian legislation in force, while also taking into account the experiences&nbsp;of foreign legal systems. Thus, in the second part, the author describes the fiscal&nbsp;implications of criptocurencies in Peru.

ResumenLa tesis que se defiende en este trabajo es que el complejo modelo institucional y territorial vasco funciona aceptablemente bien, a pesar de sus luces y sombras, y puede ser un ejemplo de la idea ampliamente generalizada de cómo un modelo de organización territorial descentralizada (y sus complejas, pero al mismo tiempo, valiosas formas de interacción entre los distintos niveles de gobierno), pueden mejorar la calidad del gobierno de sus instituciones, ayudar en el desarrollo humano, económico y social, aumentar la transparencia, administrar los recursos disponibles para ofrecer mejores servicios públicos y, en definitiva, mejorar la calidad democrática de la sociedad.Summary1. El objetivo de esta investigación fue saber si realmente las inversiones en el Bitcoin son riesgosas o no, y conocer más acerca de este nuevo mercado de Monedas Virtuales. Esta investigación se llevó acabo de manera documental, analizando la información disponible en el campo para así buscar la principal causa de incertidumbre de este mercado internacional, y conocer así sus principales ventajas y desventajas, con esto identificar si son riesgosas o no, y así poder ayudar a los lectores a tener una mejor y más sencilla idea, sobre este mercado para saber si la inversión resultara o no. Los resultados mostraron que invertir en este momento en Bitcoins no es lo más indicada, pero en un futuro, no muy lejano, este mercado será más estable y seguro para hacer cualquier tipo de inversión y transacción.

Se realiza un análisis de los componentes esenciales del proceso de gestión del desarrollo local, que han de constituirse en principios para la gestión del mismo. Se proponen cuatro principios para la gestión del desarrollo local, a saber: la descentralización, la financiación, la objetividad de la gestión y la participación. El proceso de desarrollo local no es posible al margen de la descentralización, para lo cual se necesita la definición de competencias de gestión local, comprendidas en su doble perspectiva, a saber, en sus componentes normativo y cognitivo. La financiación garantiza la autonomía para la gestión local. Para poder gestionar el desarrollo local se hace necesario poder tener una representación de la situación demográfica del territorio, pero para ello hace falta hacer una caracterización que identifique la situación real del territorio. Ello garantiza la objetividad en el proceso de gestión. Se presenta un algoritmo cuyos componentes constituyen pasos necesarios a cumplir para la instrumentación de indicadores sociodemográficos para la elaboración de las estrategias de desarrollo local. En la participación como principio, hay que tener en cuenta dos componentes ineludibles del mismo, a saber: la información-comunicación y la informatización, en el contexto del entramado institucional que le da cobertura a esa participación y los procedimientos para bregar con sus contenidos y evaluar su efecto. La información-comunicación garantiza el contenido de la participación mientras que la informatización es lo que garantiza la universalidad del acceso a la información como base para la participación social en el desarrollo local. An analysis is made of the essential components of the local development managing process, which are to be principles for managing local development. Those as principles for the management of local development are identified. And are proposed four principles for the management of local development, namely: decentralization, financing, management objectivity and participation. The process of local development is not possible taking it into apart the decentralization, necessary to define competences included from a dual perspective, namely in its normative and cognitive components. Financing is critical for local management autonomy. In order to manage local development, it is necessary a representation of territorial demographic situation, that`s why it is also necessary a characterization to identify the real demographic situation of the territory. This guarantees objectivity in the management process. An algorithm whose components are necessary steps to be followed for the instrumentation of sociodemographic indicators for local development strategies elaboration is presented. In participation principle, it is necessary to take into account two inescapable components of the same, namely: information-communication and computerization. Information-communication guarantees the content of participation while computerization is guarantees for the universal access to information as basis for social participation in local development.

Resumen:En este trabajo se reflexiona con amplia perspectiva histórica sobre la cuestiónde la organización territorial del Estado en España hasta desembocar en la situación actual y ofrecer, a la luz de esa evolución, algunas claves para la reforma constitucional en sentido federal que se entiende necesaria en nuestros días. Partiendo de la evidencia de que la respuesta ofrecida por el constitucionalismo histórico español ante la forma territorial del Estado ha sido, como tónica general, la de configurar a España como un Estado unitario, centralizado, simbolizado por la Monarquía, se analizan sumariamente los dosgrandes intentos de distinto signo que existieron antes de la Constitución de 1978 para salir del unitarismo y poner en pie modelos de descentralizaciónpolítica. La primera experiencia, de cuño federal, gestada durante la Primera República (1873-1874) se consumió en unos meses sin que pudiera discutirse siquiera el Proyecto de Constitución Federal de 1873, elaborado en el marco de una situación política y social extremadamente convulsa que desembocó en la anarquía del cantonalismo. La segunda, que durante el quinquenio de la Segunda República (1931-1936) ensayó la compatibilidad de un llamado «Estado integral» con la autonomía de las regiones, fue llevada muy parcialmente a la práctica y acabó con la sublevación militar encabezada por el general Franco y la guerra civil (1936-1939).Tras el franquismo y la Transición democrática, la Constitución de 1978 no constitucionalizó un modelo preciso y acabado de descentralización políticasino que prefiguró un Estado «descentralizable», abierto a distintas posibilidades, dando curso a un «proceso autonómico» a partir del reconocimiento del derecho a la autonomía de las nacionalidades y regiones en su Título Preliminar y el establecimiento de complejas reglas en el Título VIII. La apertura de este proceso fue evolucionando hacia el llamado «Estado autonómico» mediante la práctica política y la doctrina del Tribunal Constitucional, desarrollándose paulatinamente con las técnicas del federalismo y en su campo de atracción hasta configurar un Estado federal en los hechos, aunque con notorias carencias e incoherencias de estructura y funcionamiento. El estado autonómico entró en crisis a partir, sobre todo, de los embates del nacionalismo político en el País Vasco a comienzos de la década de 2000 y especialmente en Cataluña desde mitad de la década pasada hasta la actualidad, momento álgido del desafío secesionista. A lo largo del trabajo se intenta mostrar primero que si bien en 1873, 1931 y 1978 hubo un rotundo rechazo del centralismo y una aspiración indubitada al establecimiento de la autonomía regional bajo distintas formas, no pudo fraguarse en ninguno de estos momentos, por diferentes razones, una neta voluntad constituyente en esta materia que estuviera en condiciones de sostener eficazmente un modelo definido. Se considera que por esta y otras causas la cuestión territorial sigue estando recurrentemente abierta en canal, a la espera de una constitucionalización adecuada que permita vertebrar con la estabilidad necesaria el Estado español. Tras un diagnóstico general del modelo autonómico en su evolución en la órbita del federalismo, se abordan, de acuerdo con este planteamiento, los elementos centrales que se consideran necesarios para una reforma constitucional en clave federal que racionalice un Estado que ya es federal en los hechos y que permita integrar todos los territorios con sus singularidades, dedicando una especial atención a la cuestión catalana en el marco del actual desafío independentista.Abstract:In this work we reflect from a broad historical perspective on the question of the territorial organization of the State in Spain leading to the current situation and offer, in light of this evolution, some keys to the constitutional reform in a federal sense that is deemed necessary in our days. Starting from the evidence that the answer offered by the Spanish historical constitutionalism to the territorial shape of the State has been, in general, to configure Spain as a unitary, centralized state, symbolized by the Monarchy, we analyzed the two large and different attempts that existed prior to the 1978 Constitution to emerge from unitarianism and to establish models of political decentralization. The first experience, with a federal character, developed during the First Republic (1873-1874) was consumed in a few months without even being able to discuss the Draft of the Federal Constitution of 1873, elaborated in the context of an extremely convulsive political and social situation that ended in the anarchy of cantonalism. The second, which during the five-year period of the Second Republic (1931-1936) tested the compatibility of a so-called «integral state» with the autonomy of the regions, was taken very partially into practice and ended with the military uprising led by general Franco and the Civil War (1936-1939).After Franco’s regime and the democratic Transition, the Constitution of 1978 did not constitutionalize a precise model of political decentralization but prefigured a «decentralized» State, open to different possibilities, giving way to an «autonomic process» from the recognition of the right to the autonomy of nationalities and regions in their Preliminary Title and the establishment of complex rules in Title VIII. The opening of this process evolved towards the so-called «Autonomous State» through political practice and the doctrine of the Constitutional Court, developing gradually with the techniques of federalism and in its field of attraction until setting up a the facto federal State, although with notorious deficiencies and inconsistencies in structure and functioning. The autonomous state came into crisis starting, above all, from the clashes of political nationalism in the Basque Country in the early 2000s and especially in Catalonia from the middle of the last decade to the present, the height of the secessionist challenge.In the course of this work we try to show that, although in 1873, 1931 and 1978 there was a resounding rejection of centralism and a clear aspiration to establish regional autonomy under different forms, it could not be forged in any of these moments, for different reasons , a net constituent will in this matter that would be able to effectively support a defined model. It is considered that for this and other causes the territorial question is still recurrently open in a channel, pending the appropriate constitutionalization that allows to vertebrate with the necessary stability the Spanish State. Following a general diagnosis of the autonomous model in its evolution in the orbit of federalism, the central elements are considered according to this approach, which are are regarded as necessary for a constitutional reform in a federal key that rationalizes a State that is already federal in the facts and that allows to integrate all the territories with their singularities, devoting a special attention to the Catalan questionwithin the framework of the present independence challenge. This research work aims to study the intrinsic characteristics of the most \nrepresentative virtual currency among all the existing cryptocurrencies in the market, \nBitcoin, considering it under two points of view: as a means of payment in the \nexchange of goods and services and as a financial or investment asset for \nspeculative purposes in the short and medium term. \nLikewise, reference will be made to the different regulatory flows in terms of their \nlegal nature and, in particular, to the tax treatment in the European Union, the United \nStates and other selected jurisdictions. \nThe ultimate goal of this research is to analyze the current deficiencies of the global \nlegal status of Bitcoin in order to carry out the corresponding recommendations that \nallow an approximation to the global control of taxation and consumer protection.

The Law 5/2010 of Local Autonomy of Andalusia deepens in the capacities of the municipalities to decide on themselves: the procedures of segregation of municipal terms need express conformity of the absolute majority of the plenary session of the local government of the municipality that suffers the segregation. On the other hand, the municipalities have the possibility of spatially organizing their municipal area, or part of it, in territorial districts as a manifestation of their full political autonomy, and may be of a deconcentrated nature (hamlets, parishes, villages, neighborhoods, churches, councils, districts, adjoining and other analogous places) or decentralized (Autonomous Local Entities or Neighborhood Entities). As for the Autonomous Local Entities conformed in Andalusia, they are usually a previous step to the creation of a new municipality, for which the Law 27/2013, of Rationalization and Sustainability of the Local Administration has established a population limit that, in the practice, suppresses segregationist aspirations.
