Resumo Este artigo analisa a classificação jurídica das criptomoedas, a fim de, a partir dessa classificação, definir como se deve dar a incidência tributária em operações efetuadas com tais moedas. Para tanto, parte-se da análise do conceito de moeda no ordenamento jurídico brasileiro, com o intuito de definir se é viável classificar as moedas virtuais como moeda. No sentido de auxiliar nessa classificação, é efetuada uma breve análise do tratamento dado pelo Direito Comparado à matéria, em especial dos regramentos europeus. O estudo da experiência europeia é útil, na medida em que o Tribunal de Justiça Europeu já teve a oportunidade de decidir, no caso C-264/14 - Hedqvist, sobre a classificação jurídica das bitcoin, definindo se há incidência de Imposto sobre o Valor Acrescentado (IVA) em operações de compra e venda de bitcoin. Com base na experiência europeia e no conceito jurídico brasileiro de moeda, conclui-se que é possível considerar, para fins de incidência tributária, que operações financeiras com criptomoedas são semelhantes às operações com moeda estrangeira. A análise é feita tendo como pressuposto a necessidade de classificação de bitcoin e congêneres para o direito tributário, não tendo por objetivo estudar os impactos regulatórios que possam se originar a partir desta classificação.

De forma acadêmica e construtiva, sem pretender esgotar o assunto, o presente artigo tem como objetivo realizar um estudo jurídico e econômico do bitcoin, que é a espécie de moeda virtual mais utilizada no mundo, mediante as ferramentas metodológicas da Análise Econômica do Direito, demonstrando como o uso de bitcoins nas transações realizadas pela sociedade empresária em recuperação pode reduzir os custos de transação e contribuir para uma recuperação judicial menos custosa, mais célere e mais eficiente, colaborando, ainda, para que a recuperação judicial cumpra os seus objetivos previstos no art. 47 da Lei n. 11.101/05, quais sejam, viabilizar a superação da situação de crise econômico-financeira do devedor, a manutenção da fonte produtora, bem como do emprego dos trabalhadores e dos interesses dos credores, promovendo, assim, a preservação da empresa e da sociedade empresária, sua função social e o estímulo à atividade econômica.Palavras-chave: Bitcoins. Abstract In an academic and constructive way, without intending to exhaust the subject, this research aims to carry out a legal and economic study of bitcoin, which is the most used virtual currency in the world, through the methodological tools of Economic Analysis of Law , demonstrating how the use of bitcoins in transactions carried out by the recovering company can reduce transaction costs and contribute to a less costly, faster and more efficient judicial recovery, also helping to ensure judicial recovery meets its objectives Art. 47 of Law no. 11.101 / 05, which is to make it possible to overcome the economic and financial crisis of the debtor, the maintenance of the source, as well as the employment of workers and the interests of creditors, thus promoting the preservation of the company, its social function and stimulating economic activity. Smart contracts são criados por meio de códigos computacionais para execução automática de seus termos após a implementação da condição avençada pelas partes. Apresentam-se como fruto da Revolução Tecnológica, especialmente com o advento da internet e ganham relevância no mundo negocial após o surgimento da tecnologia blockchain, a qual permite o armazenamento dos códigos em cadeia de blocos, reduzindo os custos de execução contratual. Assim, os códigos que dão origem aos contratos inteligentes serão autoexecutáveis, autoaplicáveis e obrigatórios, e nada poderá interferir na produção dos efeitos jurídicos avençados pelas partes. São inúmeros desafios jurídicos impostos à realização dos smart contracts no Brasil, principalmente, porque inexistem leis específicas para tutela desta inovação contratual. A pesquisa buscou verificar a existência de obstáculos a execução destes contratos, à luz do princípio da função social dos contratos, por tratar-se norma principiológica cuja aplicação é indispensável a garantia do equilíbrio entre as partes durante todas as fases contratuais. Constatou-se, por meio do método dedutivo e procedimento monográfico, que as próprias características dos smart contracts executados em blockhain, obstam a efetividade das garantias inerentes ao princípio da função social, ante a irreversibilidade dos efeitos jurídicos produzidos, evidenciando, pois, a relevância do tema para a ciência jurídica.

Este artigo elucida aspectos jurídicos e regulatórios do bitcoin (BTC) com objetivo de reduzir a insegurança jurídica em que se encontram as operações realizadas com a criptomoeda no Brasil. Essa pesquisa descritiva de cunho qualitativo e método dedutivo averigua, por meio do estudo da legislação e doutrinas pertinentes, a quais órgãos reguladores do Sistema Financeiro Nacional (SFN) as operações com o BTC estão submetidas. Para tanto, são introduzidas as funcionalidades, potencialidades e limitações do blockchain, tecnologia subjacente à criptomoeda. Após, são destacados aspectos relevantes do Sistema Financeiro Nacional. Em seguida, busca-se classificação conceitual jurídica adequada ao Bitcoin. Findas essas etapas, o trabalho sugere que, em razão da natureza jurídica do bitcoin como bem intangível, no atual aparato legal, não há previsão regulatória sobre o BTC, motivo pelo qual, no momento, operações com a moeda virtual não estão submetidas a qualquer órgão do SFN.

O objetivo do artigo consiste em responder ao seguinte problema de pesquisa: a falta de regulamentação específica para as criptomoedas possui relação com a expansão das modalidades criminosas? Para responder ao referido problema, é necessário abordar o conceito de criptomoedas, sua expansão, o papel das instituições de controle e os limites jurídicos que reconhecem a existência dessa nova modalidade de tecnologia. Partimos do suposto de que o advento das criptomoedas em si não consiste em uma atividade criminosa pela ausência de regulamentação pelo Banco Central, mas sim, pode vir a se encaixar em tipos penais pelo mau uso dos softwares. A abordagem é qualitativa, com suporte em revisão de literatura e análise descritiva dos fenômenos pesquisados, além da consulta sobre a legislação sobre o tema. A contribuição é relevante pelo ineditismo e pela importância do tema no contexto financeiro e jurídico das transações realizadas em modalidade virtual. Conclui-se que não é possível associar diretamente o uso de bitcoins com a expansão das modalidades criminosas, entretanto, resta evidente que há relação subjacente entre a falta de regulamentação e a especialização de práticas criminosas que usam o ciberespaço como ambiente.

Pelo presente se busca analisar o fenômeno da moeda eletrônica Bitcoin e o impacto jurídico por esta causado, especialmente no que cerne ao confronto aparente com a soberania estatal, uma vez que dada sua internacionalidade e a dificuldade ou impossibilidade de proibição do uso, poder-se-ia em um primeiro momento vislumbrar ofensa ao instituto jurídico, o que será desmistificado. Para tanto, utilizou-se de pesquisa bibliográfica, especialmente estrangeira, dado o ainda ineditismo do tema, com autores de áreas distintas da ciência jurídica, pois assim exigido para análise das questões técnicas de funcionamento da ferramenta e também para delimitação do impacto financeiro causado pela nova moeda, emprestando conceitos e institutos da ciência econômica para aplicação. Contudo, apesar de necessário, o aprofundamento interdisciplinar se restringe ao suficiente para possibilitar a análise jurídica, a qual se dá, por sua vez, em âmbito de Direito Público, não se tendo conhecimento de análise anterior realizada sob o mesmo prisma.

This thesis discusses how the Brazilian federalism promoted, from 1997 to 2014, initiatives to develop state capacity in municipalities. This theme was taken up on the federal agenda in the first government of Fernando Henrique Cardoso (1995-1998), continued during the two terms Lula (2003-2010), and finally, in the initial mandate of Dilma Rousseff (2011-2014). The decentralization of policies started in 1988 constitutes the political and institutional context which demands to modernize its management. It's presented how evolved the managerial and administrative qualification in the cities to situate the challenges of Brazilian cooperative federalism to support these level of government. This research was organized in three theoretical dimensions and analyzed five cases. The first dimension deals with the cooperation through territorial cooperative arrangements, regarding the Federal Joint Commitee (CAF), installed in 2003, as the object of analysis because brought together representatives from federal government and from municipalist associations. One of its fields of action was the developing of municipal state capacity. The second dimension addresses the federative cooperation by means of policy systems. It was compared the Unified Social Assistance System (SUAS), created in 2005, with the education policy, that is devoid of such systemic intergovernmental arrangement. In the education the analysis rests with Articulated Action Plan (PAR), instituted in 2007. The SUAS has a wide legislation and normatization aimed for municipal entities in which highlight demands to modernize the local bodies responsible for this policy. The goal is to compare if policy systems are more effective to promote state capacity than other kinds of federative relations. Were selected two programs: the Program of Management Modernization and Tax Administration and the Management of Basic Social Sectors (PMAT), administered by the BNDES since 1997, and the National Program of Support to the Administrative Modernization and Fiscal of Brazilian Municipalities (PNAFM), managed by the Ministry of Finance and the Federal Saving Bank (Caixa Econômica Federal) since 2001. The analysis in the three dimensions shows that, considering the comparative experience in international level, and the literature about federalism and intergovernamental relations, before the manner how were organized the territorial cooperation and the implementation of federal programs in Brazil, both modalities are not viable routes to further the modernization in municipalities. The research concludes that a national and articulated policy system, both for theoretical and empirical reasons, is the most appropriated type of federative cooperative institutionality to promote state capacity in the municipalities in realities such as Brazil. In this line, in the final of the Tesis it's proposed a analytical model that considers articulated policy systems as the most adequate model to deals with this federative challenge in a setting featured by the decentralization of policies, but that at the same time lives with a great heterogeneity and inequality of state capacity among local governments.

A revolução tecnológica na área da computação e da Internet trouxe modificações importantes nos mais variados setores da sociedade. Atualmente, a maioria das transações financeiras ocorre virtualmente, nesse contexto surgiu a moeda digital Bitcoin. O conceito desta moeda foi introduzido em 2008 e pode ser descrito como a primeira criptomoeda descentralizada do mundo. As transações em Bitcoin ocorrem sem a necessidade de um intermediário e não dependem da confiança em nenhum emissor centralizado ou instituição financeira. Ao longo deste trabalho serão expostas as características, o funcionamento, as vantagens e desvantagens desta nova moeda, contrastando-a à moeda tradicional de cunho forçado. O objetivo principal é observar se essa nova tecnologia pode ser uma alternativa concorrente aos meios tradicionais, até o ponto de substituir por completo as moedas usadas nos dias de hoje, centralizadas em bancos centrais, ou se a criptomoeda será uma aliada cooperativa à moeda tradicional. Conclui-se que o Bitcoin é no curto e médio prazo uma moeda paralela, ou seja, que coopera e é aliada aos meios tradicionais.

O artigo visa entender quais as possíveis respostas a serem dadas pelo Direito em relação à criação do bitcoin. O trabalho explica, propedeuticamente, e, através da análise da legislação comparada, a história da moeda, suas consequências econômicas, as mudanças paradigmáticas ocorridas e, por fim, reflete sobre as teses doutrinárias apontadas, por parte do mundo jurídico, como solução à criação da moeda. O objetivo geral do trabalho é analisar as consequências econômicas do novo sistema de pagamento, assim como explorar as possíveis hipóteses, para regulamentar as transações com a moeda criptográfica, que permanecem em uma área cinza, ainda não completamente atingida pelo Direito. A conclusão do trabalho é que o Estado deve incluir a moeda em suas regulamentações, inicialmente, lidando apenas com à evasão tributária, com a sua possível ligação com o mercado ilegal e com a licença, para trocar tais moedas e, posteriormente, regulamentar aspectos que requerem uma minúcia maior, como a proteção dos direitos dos consumidores.Palavras-chave: Bitcoin. The study analyzes the "International Law and the constitution of Mozambique: Consensus and dissent in the light of the Global Legal pluralism". This reflective analysis will converge in the problem of the internationalization of law in contemporary society, i.e., the interaction between International Law and the Constitutional Law in the light of the global legal pluralism. After reflecting on past political, economic and social changes, it is concluded that, on the one hand, constitutionalism is neither limited nor satisfied only with the structure of the state legal space (national) and its legal order. On the other hand, International Law is no longer limited to issues related to global international policy. The phenomenon of emerging globalization has created a challenge to the international law as to the idea of a pluralist synchronization and polycentric notion of Law that could respect the legal diversity or legal specificity, within the global Legal Pluralism. The older idea of International Law entered into crisis for not having achieved the unity and cohesion within the global legal system. This crisis driven by the polycentric force of globalization dictated the diversification and the expansion of international law. This diversification has imposed the constitution and strengthening of various autonomous international legal regimes, the multiplication of organs of international conflicts resolution and the emergence of a new normative configuration. With the emergence of new instances of international and global legal production, the debate on the internationalization of Law imposes itself as an urgent need, in the framework of the globalization process and the global legal pluralism. The great debate today, on this theme, departed from general International Law and is set in the context of the new global international legal order. The debate on the internationalization of law took two aspects: one on the protagonism of new instances of autonomous global and international legal production and its influence in the construction of the global international legal order. Another aspect is that of regional economic and political blocks and of organizations and institutions of humanitarian aid and development, under the same prism. This debate brings back the old or new problem of interaction between International Law and the Constitutional Law in the new global international legal order, i.e., the problem of internationalization of national law. In fact, some international rules emanating from autonomous international legal production organs, within the framework of hegemonic globalization, are imposed directly to citizens and States, sometimes without knowledge of such rules, or of its existence. The action of these organs or agents can be considered as a latching and destructive phenomenon within the national legal orders? These rules are imposed on citizens and States not only as strategies or means of operationalization of flows, for the success of the process of globalization and economic development, but also, sometimes, for unclear purposes and within wide range economic interests. With the introduction of the new international legal regimes, the relationship with National Law has decentralized, thus creating a polycentrism, where each regime seeks to draw to itself the protagonism. This phenomenon has created conflicts within National Law and between the various legal systems. It is noted that each legal regime has its specific rules of internationalization of law. The National Law, in the face of this diversity, must meet several distinct rules and sometimes contradictory. There are times when the same matter is subject to various internationalizations by different legal regimes and through distinct rules to that effect. The proliferation of various regimes and agents in the internationalization of Law has weakened the policies and measures of protection and rule production in peripheral States because of the overlap and complexity of the phenomenon. In this new global legal order, unfortunately, we are witnessing the phenomenon of international legislative hegemony led by the major powers with regard to the demands of globalisation. This unusual phenomenon, lived in the global society, is translated into anti-constitutional and anti-democratic practices in the creation and internationalization of law in peripheral countries. The study starts from the analysis of the relationship between international law and the constitution of Mozambique and returns to the debate on the problem of the relationship between International and National Law, in the framework of the new global international legal order.

ON 12 JANUARY 2009 a pseudonymous entity signed a transaction that instructed a distributed network to transfer a small amount of digital currency to Hal Finney, one ofthe key figures of the cypherpunk movement. After a few minutes, the transaction was recorded on a distributed public ledger, permanently updating the balance ofbothparties. This transaction— the first Bitcoin transaction—marked the beginning of a new era of decentralized payment systems, ushering in a variety of financial Services that do not depend on any centralized clearinghouse or other financial middleman. Bitcoin is regarded by many as a powerful technological innovation that could disrupt many sectors, in the realm of finance and beyond. But the underlying technology on which the network operates, the Bitcoin blockchain can do much more than that. Just as the internet did in the early-1990s, blockchain technology carries with it a whole new range of promises concerning how decentralization can support and promote individual freedoms and autonomy. Blockchain proponents believe that Bitcoin and other cryptocurrency platforms will revolutionize mechanisms of value exchange in the same way that the internet transformed information sharing, by providing a platform for people to exchange digital resources, in a secure and decentralized manner without the need to rely on any intermediary or trusted authority. But this revolutionary potential also carries with it serious implications for censorship, intellectual property, and the regulated flow of information. A blockchain is a decentralized database of transactions maintained by a distributed network of computers, which all contribute to the verification and the validation of transactions. Once accepted, these transactions are recorded inside a “block” of transactions, which incorporates a reference to previous blocks. This creates a long chain of blocks—a “blockchain”—that stores the history of all transactions in a chronological order. Every block contains information about a particular set of transactions, a reference to the preceding block in the blockchain, and the answer to a complex mathematical puzzle that is used to validate the data associated with that block. A copy of the blockchain is stored on every computer in the network, making it virtually impossible for anyone unilaterally to modify the data stored on this decentralized database: if anyone tries to modify any transaction the fraud will be immediately detected by all other network participants.

This dissertation is a study on the organization form of the Brazilian Unified Health System -Sistema nico de Sade (SUS) that, according to article 198 of the Brazilian Federal Constitution, is a system of federative interdependence managed by autonomous entities, as set forth under article 18 of such Constitution. It adopts an interdisciplinary approach, with emphasis in the legal standpoint and interpretation of the major guidelines of the Principles embedded in the Constitution and the protection of the Basic Human right to Health. There is an initial focus on the conceptual framework of Federalism and the traditions where the Brazilian Model got its background. The Brazilian State and its organization form and structure for the Health are scrutinized: the role of the Federal State, its centralistic imposition and influence on SUS' management. The study analyses how the characteristics of federative interdependence and mutual relationship, are harmed by the strong presence of central authority, the Federal Government, through the Brazilian Health Ministry. Concerning the SUS, the federal centralism is materialized through the form of its financing, since a large amount of resources that supports it is assigned by the federal Government to programs and projects determined by federal scope, prevailing over a federal or decentralized system. That situation has a strong impact on SUS' organization, defining its priorities rather by the sources of its financing than by global health planning, that should have as its foundation the peoples need for health. The interdependence and autonomy require solutions that reaches a compromise between these contradictions, assuring to SUS a legal and administrative structure that allow overcoming its contradictions, in order to bring together an efficient system. To achieve this purpose, some ideas are presented, ideas that attempt to reconcile all required elements to a management that guarantees to citizens the right to health.

The objective of this article is to discuss alternatives to finance investments by municipalities. In general, current revenues are insufficient to finance large investments, what brings about the necessity of municipal indebtedness. These could assume different manners, according to the nature of the investment: if it is typically public or if it offers private return. For the first case, we discuss the possibilities of a municipal bond market and, for the second, we discuss project finance and the participation of the private sector.
