Role of Blockchain Technology in Enhancing Data Security in Germany

Purpose: To aim of the study was to analyze the role of blockchain technology in enhancing data security. Methodology: This study adopted a desk methodology. A desk study research design is commonly known as secondary data collection. This is basically collecting data from existing resources preferably because of its low cost advantage as compared to a field research. Our current study looked into already published studies and reports as the data was easily accessed through online journals and libraries. Findings: Blockchain technology is increasingly recognized in Germany for its potential to enhance data security across various sectors. Its decentralized and immutable nature significantly reduces the risks of data tampering and unauthorized access, thereby fostering trust among users. In industries such as finance, healthcare, and supply chain management, blockchain provides transparent and secure methods for recording transactions and managing sensitive information. Additionally, German regulatory frameworks are evolving to accommodate blockchain applications, promoting innovation while ensuring compliance with data protection laws like the GDPR. Unique Contribution to Theory, Practice and Policy: Technological acceptance model (TAM), diffusion of innovations (DOI) & resource-based View (RBV) may be used to anchor future studies on the role of blockchain technology in enhancing data security. Organizations should implement pilot projects to assess the effectiveness of blockchain in enhancing data security in their specific contexts. Policymakers should develop clear regulatory frameworks to support the adoption of blockchain technology across sectors.

Regulatory options for integrating zero-knowledge proofs into the European Digital Identity Wallet

On 30 April, Regulation (EU) 2024/1183 amending Regulation (EU) 910/2014 as regards establishing the European Digital Identity Framework, known as eIDAS 2.0, was published in the Official Journal of the European Union. This amendment introduces zero-knowledge proof (ZKP) privacy-enhancing technologies to support two key innovations: the European Digital Identity Wallet (EUDIW) and the electronic attestations of attributes ((Q)EAA). In parallel, the European Digital Identity Wallet Architecture and Reference Framework (EUDIW ARF) provide a common set of standards and best practices for the technical implementation of eIDAS 2.0. This paper analyses how the EUDIW can rely on ZKPs since neither the eIDAS 2.0 Regulation nor the EUDIW ARF does so. We propose a software product regime for the cryptographic derivation of data in a ZKP format through three mutually compatible regulatory options: zero-knowledge issuance by default through the EUDIW, through a software product extension of the EUDIW, or a private standalone wallet. These schemes provide the legal basis for the secure use of ZKPs, ensure effective compliance with the GDPR, and contribute to the debate on the value that electronic ledgers introduced by eIDAS 2.0 bring to digital identity.

Bitcoin: Keine Anwendbarkeit des ZaDiG 2018.

§ 1 BWG; § 1 E-GeldG; §§ 1, 4, 67, 87 ZaDiG 2018. Das Vorliegen eines Zahlungsvorgangs sowie eines Zahlungskontos setzt voraus, dass sie sich auf „Geldbeträge“, also Banknoten und Münzen, Giralgeld oder E Geld beziehen. Bitcoins sind aber weder (auf eine gesetzliche Währung lautende) Banknoten und Münzen noch Giralgeld oder E-Geld. Eine direkte Anwendung des ZaDiG 2018 (insb dessen §§ 67, 87) scheitert daher an der fehlenden Eigenschaft von Bitcoins als „Geld“ und dem folgend am Fehlen eines Zahlungsvorgangs und - wie hier - am Fehlen der Eigenschaft der Beklagten als Zahlungsdienstleister.

Anonymity on the Bitcoin Network : a comprehensive examination of entity and transaction tracking techniques on the Bitcoin blockchain

Das Ziel dieser Bachelorarbeit ist die Darstellung von Techniken zur Verfolgung von Transaktionen und Entitäten auf der Bitcoin Blockchain. Die zugrundeliegende Forschungsfrage lautet wie folgt: Welche Aussagekraft und Grenzen haben Heuristiken und Analysemethoden zur Nachverfolgung von Bitcointransaktionen und wie wirken sie sich auf deren Anonymität aus? Zur Beantwortung der Forschungsfrage wird eine Literaturrecherche durchgeführt. Die Funktionsweise der Methoden wird dargestellt, Stärken und Schwächen der Methoden werden aufgezeigt und gegebenenfalls Verbesserungsvorschläge gemacht. Es zeigt sich, dass die Anonymität des Bitcoin-Systems aus verschiedenen Richtungen eingeschränkt werden kann. Die vorgestellten Analysemethoden haben jedoch ihre Grenzen und können die Anonymität des Bitcoinsystems nicht endgültig überwinden. Letztendlich bleibt festzuhalten, dass die Anonymität eines Nutzers von seiner Bitcoin-Nutzung und der Nutzung seines Umfelds abhängt. Ein bewusster, anonymer Umgang mit der Kryptowährung ist die Grundlage für eine solide Privatsphäre.

Distributed Ledger Technology (DLT) has been contentious since the emergence of blockchain in 2008. Security and compatibility with the personal data rights in the EU General Data Protection Regulation (GDPR) are among the controversies that have erupted. Thus, various studies have concluded that the decentralisation and immutability of DLT conflict with personal data rights. This dissertation illustrates that the DLT can be compatible with the GDPR personal data rights.

Zur Auswirkung eines Stakings auf die Rechtsposition der Kunden im Falle der Insolvenz des Kryptoverwahrers

Zusammenfassung Für die Vertrauenswürdigkeit von Finanzdienstleistungsinstituten, die das Kryptoverwahrgeschäft nach § 1 Abs. 1a Satz 2 Nr. 6 KWG betreiben, ist es essenziell, dass die Kunden ihre verwahrten Kryptowerte in der Insolvenz des Instituts aussondern können. Wäre dies nicht der Fall und würde den Kunden im Fall der Insolvenz des Instituts womöglich ein Totalverlust drohen, würde dies die Attraktivität des Geschäftsmodells der Kryptoverwahrer erheblich beeinträchtigen und voraussichtlich Kunden dazu bewegen, die Verwahrung der eigenen Kryptowerte bzw. kryptographischen Schlüssel ohne Rückgriff auf ein solches Institut selbst zu übernehmen. Demgegenüber löst die Aussicht auf eine Rendite durch das sog. Staking für die Kunden einen Reiz aus. Im Rahmen des Stakings werden die Kryptowerte durch den Inhaber selbst oder seinen Kryptoverwahrer für den Proof-of-Stake-Konsensmechanismus einer Blockchain hinterlegt, wodurch sich fortlaufend weitere Kryptowerte verdienen lassen (sog. Rewards). Von einem einzelnen Kunden lässt sich dies in aller Regel nicht effizient durchführen, sodass diese Aussicht auf ein passives Einkommen für eine Verwahrung durch entsprechende Institute spricht. Es könnte insofern ein Zielkonflikt zwischen Insolvenzschutz und Renditechancen bestehen, d. h. die Aussichten auf eine Rendite könnten sich negativ auf den Schutz der Kunden in der Insolvenz des Kryptoverwahrers auswirken. Der Beitrag untersucht daher, ob und wann ein solcher Einsatz von sammelverwahrten Kryptowerten für den Proof-of-Stake-Konsensmechanismus (Staking) Aussonderungsrechte kraft fremdnütziger Treuhand oder kraft unwiderleglicher Vermutung nach § 46i KWG n. F. tangiert. Die Autoren schlagen eine aus dem BGB abgeleitete „Früchtelösung“ vor, mit der das Staking bei vollem Schutz der Kunden in der Insolvenz des Kryptoverwahrers ermöglicht wird.

Conflict of Laws and Tokens in Swiss Private International Law

Switzerland figures among one of the first jurisdictions to include distributed ledger technologies (DLTs) in its legal framework through the recently adopted federal act commonly referred to as the DLT Act. In order to address the complex issue of determining the law applicable to tokens stored on a DLT, the DLT Act amended on 1 February 2021 the Swiss Private International Law Act (PILA), which now provides for conflict-of-laws rules that notably applies to tokens that embed a claim. This article aims to explain the context in which this amendment took place by providing an overview of the notion of tokens and presenting the main purposes of the DLT Act. It then presents and discusses the solutions chosen by the Swiss lawmaker, which follow the general principles that also generally prevail for other types of rights. As a result, the issuer of a token benefits from considerable freedom to determine the governing law of a tokenised claim. Absent a choice of law, the PILA sets forth subsidiary solutions based on the seat and the habitual residence of the issuer.

MEDENÎ USÛL HUKUKU AÇISINDAN NFT’LERİN DELİL OLARAK DEĞERLENDİRİLMESİ

Teknolojinin gelişimiyle birlikte kişiler arasındaki etkileşim hızlanmıştır. Özellikle fiziki ortamda yapılabilen hukuki işlemlerin dijitalleştirilmesiyle bu etkileşim saniyeler içerisinde gerçekleştirilebilmektedir. Ancak dijitalleşmeyle beraber yapılan işlemlerin güvenliğine ilişkin tereddütler de oluşmaktadır. Bu tereddütlerin ortaya çıkmasıyla birlikte elektronik ortamdaki belgelerin güvenirliğine ilişkin olarak elektronik imzaya yönelik düzenlemeler yapılmıştır. Bunun sonucunda, güvenli elektronik imzalı olarak düzenlenen belgelerin de el yazısıyla imzalı belgeler gibi güvenilir olabileceği ortaya konulmuştur (EİK m.5/1, TBK m.14/2). Bununla birlikte teknoloji ve dijitalleşme her geçen gün geliştiğinden güvenilir dijitalleşmeye ilişkin olarak blokzincir teknolojisi ortaya çıkmıştır. Bu teknolojinin bir örneğini de NFT’ler (Non-fungible tokens) oluşturmaktadır. NFT’ler değiştirilemeyen dijital varlıklardır. Başka bir ifadeyle NFT’ler gayri maddi varlık olarak nitelendirilmektedir. Bu varlıklarla ilgili telif hakkına, alınıp satılmasına ilişkin bazı uyuşmazlıkların ortaya çıkması söz konusu olabilir. Böyle bir durumda NFT’lerin hukuk yargılaması açısından senet niteliğinde olup olmadığının belirlenmesi önemlidir. Medenî usûl hukuku anlamında NFT’lerin hukuki nitelendirmesinin ispat hukuku açısından değerlendirilmesi gereklidir. Dolayısıyla bu çalışmada, ispat hukuku açısından NFT’lerin hukuki niteliği belirlenmeye çalışılmıştır.

Distributed Ledgers And Their Implications In Information Technology Law

Electronic communications security has gained a considerable significance in parallel with the increasing usage of the information and communication technologies. Being one of these technologies, distributed ledger technologies (DLTs), more specifically the blockchains, are regarded as a revolution which propose a new era, called “blockchain of things” following the era of “internet of things”. While DLTs promoted the business functionalities and compliance with information security obligations, it has also some vulnerabilities. By the DLTs the cost of intermediaries could easily be eliminated while at the same time assets/transactions are recorded and secured digitally. Nevertheless, this has simultaneously resulted in decentralised power/anarchy. Besides, majority of the studies focus on the contributions of the DLTs. This article aims to concentrate on the security aspect of this technology, which is often disregarded. Thus, after addressing fundamental characteristics of DLTs, it will unfold their tools and advantages in terms of compliance to information security obligations, then, exercise its vulnerabilities and related risks with respect to information security legal frameworks from over the world.

Smart Contract – Problems with Taking Evidence in Polish Civil Proceedings in the Light of European Regulations

In recent years, we have observed an amazing development of new technologies; many contracts come into effect without paper documents being signed. New possibilities have appeared, for example, the smart contract (also known as the digital contract or blockchain). In some cases, there is a dispute between the participants in the smart contract, e.g., as to the manner of its implementation. A court case might be necessary to resolve the dispute. As in any dispute, evidence proceedings will have to be conducted. The smart contract should appear as a proof. However, due to its unusual nature and complicated status under substantive law, as well as the fact that it is produced by new technological solutions, it is essential to determine its admissibility as evidence. The procedural law regulates in detail only traditional evidence. The smart contract has not been regulated in procedural regulations, therefore, its status needs to be established in the context of the existing documentary evidence. This article aims to contribute to the discussion on the status of smart contracts in civil court proceedings. Primarily, it should be determined whether the smart contract can be considered a document within the meaning of procedural law. In the Polish legal system, the document is defined as an information carrier whose content can be read. Accordingly, the smart contract meets the definition criteria. However, in the absence of provisions governing the manner of taking documentary evidence, it may be difficult to actually take such evidence and establish its value. The article also draws attention to Regulation (EU) No 910/2014 of the European Parliament and of the Council on electronic identification and trust services for electronic transactions in the internal market and repealing Directive 1999/93 / EC. Its art. 46 refers to the legal effectiveness of electronic documents and prohibits discrimination against evidence from such documents, which should undoubtedly contribute to the acceptance of a smart contract as evidence in civil proceedings.

Bitcoin - Wie Social Media Privatanlegende in ihrem Handeln beeinflussen

Bitcoin ist, plakativ ausgedrückt, digitales Gold: Das Angebot ist fixiert und somit das härtere monetäre Gut als klassische Fiatwährungen. Der Wert gegenüber dem USD stieg zwischen 2011 und 2021 um durchschnittlich 230 % pro Jahr, was es zur erfolgreichsten Anlageklasse der Welt macht. Erfolg zieht Privatinvestorinnen und -investoren an. Diese informieren sich oftmals über Social-Media-Kanäle wie Twitter über Trends und lassen sich vom herrschenden Sentiment beeinflussen. Die Eintrittsbarrieren sind tief. Jeder hat schnell ein Bitcoin-Wallet erstellt und ist Teil der Bewegung. Wenn ein Preis ohne fundamentale Ursache stark steigt, erhöht sich dadurch der ebenfalls nicht fundamental bedingte Spielraum nach unten. Die hohe Volatilität ist ein Merkmal des noch jungen Marktes. Die Mehrheit der Privatinvestorinnen und -investoren kann mit diesem Druck nicht umgehen. Viele verlassen den Markt bereits nach wenigen Wochen oder Monaten in Panik, wenn ein satter Verlust anstelle eines hohen Gewinns eingetreten ist, um das übriggebliebene Investment vor einem Totalverlust in Sicherheit zu bringen. Mithilfe von Fachpersoneninterviews werden in der vorliegenden Arbeit theoretische Aspekte mit Erfahrungen aus der Praxis ergänzt, um einen ganzheitlichen Blick auf die Wechselwirkung des Verhaltens von Markt und Privatanlegenden zu erhalten. Indem verlässliche Twitter-Accounts mit Mehrwert gesucht werden, sich nicht auf eine einzige Informationsquelle verlassen sowie eine klare und langfristige Strategie verfolgt wird und das Investment auf fundierten Kenntnissen gründet, kann eine Neuinvestition in diesem Markt bestehen, denn der Markt geht mittel- und langfristig nach oben.
