PROTECTION OF RND-TECHNOLOGIES IN THE CONDITIONS OF DIGITALIZATION

Natalia Makarchuk

This article explores the possibility of using digital technologies, primarily distributed Ledger (blockchain) technology, to protect RnD-technologies, which are generally understood as the results of research and development, as well as the process of their creation. The legal protection of such technologies through traditional legal mechanisms is inadequate. Therefore, in the context of global changes in law, the problems of legal regulation and legal protection of RnD-technologies require deep doctrinal understanding.

Following the cryptocurrency Bitcoin

Zuzana Zelenková

The subject of the thesis is the parallel digital economy created around the monetary innovation called Bitcoin and the interaction between this technology and its users. Bitcoin is a new kind of digital money and a payment system. Transactions are cryptographically verified by users and subsequently recorded in a publicly distributed account book called blockchain. Bitcoin, as an open-source project, has created a worldwide community of Internet-connected users who are further transforming this cryptocurrency by their specific use. Ethnographic research took place during the meetings of the community surrounding the Prague place called Parallel Polis in the period of years 2017-2018 and was subsequently extended to the "online" world. Bitcoin forms the intersection between technology and the economy, and therefore emphasis is placed on exploring the dynamics that this complex phenomenon creates. The work examines the social practices that actors are constantly shaping on the basis of their various motivations through their participation in Bitcoin and the complex ideas connected with it. It examines the visions, attitudes and practices of the "bitcoiners", who support the functioning of this system and allows its very own existence. These ideas are characterized by certain paradoxes and dilemmas...

Problem of Protection against Cyber Crimes in the Field of Cryptocurrency Circulation

Kateryna Chyzhmar, Olеks, r Yunin, Iryna Paterylo · 6 authors

In the course of the study, cases of interaction of a cryptocurrency system with external subjects were identified. Such connections are manifested mainly in the protection of rights of participants in the cryptocurrency market in the event of an offense, respectively, the issue of punishment of offenders, taxation issues, as well as the performance of the cryptocurrency as a medium of circulation outside the cryptocurrency market. Due to the misregulating of the algorithm of such relationships at the legislative level, many violations of the rights and interests of both the participants of the cryptocurrency market and these very external actors arise. The way to resolve problematic issues is to develop a legislative framework. First, since each state at the national level regulates the process of cryptocurrency circulation in its own way, and the cryptocurrency market covers the whole world, it becomes necessary to establish common rules, as well as to develop a conceptual and categorical apparatus at the international level. Such an act can even be documented as a legal custom, such as IncotermsNÂÂŽ After determining the main points regarding the circulation of cryptocurrency in the world at the international level, each state will be able to develop norms at the level of national legislation on some basis. Today it is very important to realize that the emergence of a cryptocurrency (digital money) is a globalization phenomenon. Cryptocurrency is a class of financial assets that is developing and gains popularity more quickly than others and is both a prospect and a threat to the entire global financial system. Therefore, it is necessary to take control of this phenomenon in advance in order to be ready for its appearance in the financial markets.

Legal regulation of the turnover of cryptocurrencies in foreign countries and in the Russian Federation: possible approaches

The paper presents a comparative analysis of approaches to the legal regulation of cryptocurrency transactions in various foreign States. It is noted that neither in the doctrine nor in the legislation of various foreign countries there are no common solutions, even on the issue of applicable terminology. In this regard, the analysis of the selected regimes of cryptocurrency regulation in the main States is carried out. The prospects for the introduction of the Russian Federation's own "oil and gas" cryptocurrency are still uncertain. At the same time, there are proposals on a possible direction of regulation of cryptocurrency turnover by making appropriate changes to the domestic currency legislation.

Legal Studies of Private Enforcement Accompanied by Smart Contracts

Changhee Kim

Could Russia Utilize Cryptocurrencies in Its Foreign Policy Grand Strategizing?

Nicholas Ross Smith

Russia, under the stewardship of Vladimir Putin, has arguably taken a number of steps to try and secure a position as a pole in an emerging multipolar world. One step has been to modernize its military and reassert itself globally (evident in its Syria action), while another step has been to try and hasten the decline of the United States (evident in its BRICS cheerleading). It is argued that the latter step is particularly difficult to achieve because the United States still has a significant power advantage over the rest. Additionally, the United States' hegemonic position is further insulated by having the U.S. dollar as the global
