Dinamika Pasar Cryptocurrency: Pengaruh Harga Bitcoin, Emas, Minyak Mentah, Dan IHSG Terhadap Ethereum Dan Binance Coin

Rus Hertanto, Masruri Muchtar, Pardomuan Robinson Sihombing

Intention to adopt a blockchain-based halal certification: Indonesia consumers and regulatory perspective

Etikah Karyani, Ira Geraldina, Marissa Grace Haque, Ahmad Zahir

Purpose Halal certification is an acknowledgment of the halalness of a product or service issued by a halal regulator based on Islamic law. This study aims to investigate the intentions of consumers and regulators toward blockchain-based halal certification. Blockchain is useful for storing and verifying halal certificates, thereby increasing trust in products or services because the public cannot change or access data once it is stored. Design/methodology/approach This study uses a triangulation approach by distributing online questionnaires to consumers as a research instrument of a quantitative approach processed with smart partial least squares. Meanwhile, the qualitative approach is carried out through observation, in-depth interviews with the Ministry of Religion’s Halal Product Assurance Organizing Agency (BPJPH) and Halal Examination Agency (LPH), and forum group discussions (FGDs) with several related parties. Findings The observation results show that most consumers expect the government to provide an easy-to-use application to check halal food products and restaurants. Consumers’ intention to use this technology is influenced directly by attitudes and indirectly by their beliefs. Furthermore, the results of interviews and FGDs reported that LPH was not ready to apply blockchain technology, while BPJPH strongly supported adopting blockchain technology in the certification process. Practical implications This finding recommends that the Indonesian government apply blockchain technology to gain transparency and accountability regarding the halal product process. Originality/value This study fills the research gap by observing three perspectives from different stakeholders and using a triangulation approach to analyze the need for adoption of blockchain-based halal certification of halal food products.

Bambang Santoso Haryono, Tommy Anggriawan, Drasospolino, I Gede Eko Putra Sri Sentanu · 5 authors

Recent studies reported that the implementation of local budgeting in the context of fiscal decentralization policy had no significant contribution in increasing rural community welfare. This study therefore evaluated the local budgeting policy implemented in Indonesia through Village Fund (VF) policy as well as examining the mediating role of local community empowerment. This investigation used crossectional data from 399 respondents from villages in Indonesia. The measures used in this study involved villagers' perception about policy and implementation of village fund, the success of rural welfare and local community empowerment. PLS-SEM was used to test the hyphoteses. The result of this study evidences that perceived of VF usage measured by perceived infrastructure development and perceived basic social services, except for perceived VF usage in rural economic development, have less significant impact on rural community welfare. Moreover, perceived involvement of community empowerment has minimum contribution on perceived rural community welfare. This study provides an understanding of paradox existing in the perceived role of local community empowerment in mediating the effect of local finance budgeting on rural welfare which is still rarely studied particularly in developing countries like Indonesia.

Az Zahra Nashira Ryan, Aris Prio Agus Santoso, Giovania Madeira Do Carmo, Jonathan James Kurniawan · 5 authors

The use of cryptocurrency assets in Indonesia is still prohibited as a means of payment but as an investment instrument it can be included as a commodity that can be traded on a term exchange as regulated in the regulation of Law No. 10 of 2011 concerning amendments to Law No. 32 of 1997. The positive impact of cryptocurrencies in consumer protection such as cryptocurrency financial access can provide access to the traditional banking system, thereby increasing financial inclusion. There are also negative impacts to consider in consumer protection: security risks associated with theft or hacking of cryptocurrency exchange platforms and digital wallets can threaten the security of consumer funds. This study aims to analyze about consumer protection of cryptocurrencies in the digital age. This research uses normative research methods and uses qualitative data types. The results of this study show that consumer protection in cryptocurrency in the digital era, among others, preventively, in cryptocurrency trading transactions as assets is also strengthened by the Regulation of the Commodity Futures Trading Supervisory Agency Number 9 of 2019 concerning Amendments to the Regulation of the Commodity Futures Trading Supervisory Agency Number 5 of 2019 concerning Textile Arrangements for the Implementation of the Physical Market of Cryptocurrency Assets on Futures Exchanges. Meanwhile, if repressively to protect what is given after a dispute arises in the form of sanctions, fines, imprisonment, and penalties imposed a dispute occurs, regulated in Article 22 of PerBappeti Number 5 of 2019 concerning Technical Provisions for the Implementation of the Physical Market of Cryptocurrency Assets on the Futures Exchange, that dispute resolution is carried out by deliberation to reach consensus if it does not reach consensus the parties can resolve through the Futures Trading Arbitration Agency Commodity (BAKTI) and the State Court as stated in the agreement between the parties. Bank Indonesia reaffirms the ban on the use of virtual currencies in cryptocurrency, both in the form of selling, buying, and trading with these currencies.

Melihat ‘Yang Banyak’ pada Web3 melalui Pemikiran Antonio Negri

Penti Aprianti, Anthonio Calvin Bawotong

Modern culture, which began to develop since the 18th century, became a catalyst for the growth of information technology systems, especially the internet, which has now reached the Web 3.0 or Web3 level. At this level, the internet becomes a decentralised space when users have complete autonomy and control over the data they share consensually. However, because it is a force steeped in exploitative and manipulative agendas, Web3 is potentially vulnerable to commodity fetishism and perhaps even a return to forms of domination through capital accumulation. As a result, elements in Web3 that were promoted as resistance to internet privatization have instead become opportunities for exploitative parties to accumulate wealth. This article delves deeper into how Web3 shows the tension between dominant currents and resistance to global multinational power systems. In this context, the authors use Antonio Negri’s perspective in Empire and Multitude to investigate the complex dynamics that occur. By understanding how Web3 interacts with dominant forces and their resistance, one can explore the potential and challenges faced in positioning the development of the internet towards a more inclusive and equitable realm.

Keabsahaan Bitcoin Sebagai Objek Jaminan Dalam Kepailitan

Nuraffa Siti Aisah, Umi Khaerah Pati

The development of cases or cases in terms of bankruptcy debtor assets, does not rule out the possibility of bitcoin becoming one of the assets or all assets of bankruptcy debtors given the large number of Indonesians who use bitcoin as an investment tool. Therefore, further study is needed regarding the validity of bitcoin as an asset in terms of the Civil Code and Indonesian Positive Law, as well as the validity of bitcoin as an object of general collateral for bankruptcy debtors. This research is a normative legal research (doctrinal research) with a statutory approach method and a conceptual approach using library research data collection techniques including primary and secondary legal materials and analyzed with interpretation techniques. The results of this study indicate that bitcoin is recognized as a commodity subject to VAT and Income Tax (Article 1 number 7 of Bappebti Regulation Number 5 of 2019 and Article 19 of the Minister of Finance Regulation 68 / PMK.03 / 2022). Based on the Civil Code, bitcoin is an intangible asset in the form of digital assets and is movable (Article 503 and Article 504 of the Civil Code) which can be attached to property rights (Article 499 of the Civil Code) and the owner of bitcoin can freely perform legal actions on the bitcoin owned. Bitcoin has fulfilled the elements of a collateral object, namely that it can become property rights, has economic value, can be executed, so that it can be used as an object of general collateral and can be included in the bankruptcy estate.

Analysis of Virtual Currency Trading Cryptocurrency as a Transaction Tool in Indonesia

Dian Ekawati, Toto Tohir Suriaatmadja, Susanto Susanto

This study aims to analyze the business of trading virtual currency cryptocurrency, particularly Bitcoin, as a means of transaction in Indonesia. The research method employed is a normative juridical approach, examining provisions related to the use of Bitcoin as a transactional tool in Indonesia. The findings of this research reveal several significant outcomes. Firstly, the business of trading virtual currency cryptocurrency, especially Bitcoin, as a means of transaction in Indonesia, still faces significant challenges. Despite the high public interest in cryptocurrencies, clear and definitive regulations regarding the use of virtual cryptographic currency as a payment instrument are still lacking. Secondly, the role of Bank Indonesia as the financial regulator has not yet recognized Bitcoin as a valid payment instrument in Indonesia. This results in legal uncertainties concerning the use of Bitcoin as a transactional tool in the country. The research findings indicate that the use of Bitcoin as a means of transaction in Indonesia lacks adequate legal certainty. Therefore, the business of trading virtual currency cryptocurrency as a transactional tool in Indonesia requires clear and definitive regulations. Appropriate regulations will provide legal certainty, protect all involved parties, and ensure fair and sustainable state revenue related to the use of Bitcoin as a means of transaction in Indonesia. The implications of this research emphasize the need for clear and definitive regulations in the business of trading virtual currency cryptocurrency as a means of transaction in Indonesia. Bank Indonesia and other relevant authorities need to collaborate in developing an effective regulatory framework. With proper regulations, cryptocurrencies can be integrated securely, reliably, and widely accepted as transactional instruments in Indonesia.
