Features of functioning of territorial communities and formation of their material and financial support

Оlha MALINOVSKA, Уляна Моторнюк

Introduction. Transformation processes in Ukraine dictate the need to formulate such a concept of state financial policy, which would be the beginning of economic growth. This primarily leads to the creation at the territorial level of strong economic and financial systems that can independently solve local socio-economic problems. It is necessary to determine the role of material and financial support in the life of local self-government, the boundaries of a harmonious combination of economic feasibility of the existence of territorial communities with the main goal of the existence of local self-government in general - to meet the basic vital needs of citizens at the place of residence. The purpose of the paper is to study and analyze the material and financial provision of local communities during decentralization. Results. The analysis of the essence of the concept of "material and financial basis of local self-government" suggests that it is quite multifaceted. In some cases, it focuses on its economic essence, in others it is legal. Although the link and the significance of both spheres are evident. This is also explained by the dual nature of property and finance, namely, economic and legal. Principles of the formation of the material and financial basis of local self-government are the initial principles, ideas and principles, which are the basis of the organization and activity of the territorial communities, the population, representative bodies which they are formed, local executive bodies, caused primarily by the essence of local self-government those involved in the management of local material and financial resources. On the one hand, the material and financial basis is divided into two parts: material and financial. On the other hand, the components of the material and financial basis of local self-government are: first, communal or municipal property (in Ukraine, the communal property is recognized and regulated by law); and secondly, revenues (revenues) of local budgets and other funds; and thirdly, another property that is designed and used to meet the local needs of the population. Conclusion. Considering that the right to education, medical care guaranteed, guaranteed by the constitution, etc. should be ensured, and in order to prevent a biased distribution of financial resources in budget calculations, it is necessary to organize work on the calculation and consolidation at the legislative level of normative indicators of financial support of existing state social standards.

Transformation of the National Educational System in the context of decentralization

Iryna Zastrozhnikova

The article considers the main aspects and problems of transforming an educational network in the current context of decentralization. Reference is made tothe urgent need of restructuring the responsibilities in education management between the center and regions providing the latter with independence in finances, organization and management at the regional level. It is emphasized that extending powers of the local executional bodies in management of educational institutions is the primary purpose of decentralization process. There was examined a pattern of decentralizing the basic education in Poland, according to which it was recommended to oblige the local self-government bodies to implement the education politics according to the local needs, finding the school administration and continually appraise the quality of education. It has been observed that currently the essential functions of state in education are assigned to the regional state administrations, regional and local educational departments. The local authorities are burdened with responsibilities of financing and providing the social security for children, defining the network of training institutions, maintaining their records and performing control over their activities. The author points out that at present the local and regional authorities duplicate the functions of the Ministry of Education and Science of Ukraine, which is non-effective. The author believes that the local government officials are able to perform political management well up to the officials of educational departments and administrations. However, prior to assignment of new obligations, it is necessary to develop and implement an effective retraining program for personnel and staff of the municipal structures. There have been reviewed the results of the pilot project: «Decentralization: education reforms at the local level», which experts had been analyzed the consistency of educational network. It pointed to the major areas of concern for the education reforms in local communities, namely a significant expense side of budget for education financing, low level of education in rural students according to the data obtained from the independent external assessment, and lack of subject oriented teachers. The author makes a conclusion that the purpose of decentralization in education should be an overall improvement of educational services and be based upon the following basic principles: students’ right to have a free choice of educational institution, equal access to good-quality education services, decent conditions to develop their abilities, improving the quality and efficiency of the educational process, effective use of types of resources.

Prerequisites for the Introduction of Virtual Currency (Cryptocurrency) Control in Ukraine

Anastasiia Mamonova

Observing the rapid uptake and active use of virtual currencies that are not found in every country in the world, regulators are asking questions about the ability to control and regulate their operations. Therefore, the article describes approaches to determining the economic nature of virtual currencies and analyzes their legal regulation and transactions with them in the world and in Ukraine. The status and official attitude of the regulatory bodies of different countries, consolidation of legislation and taxation of virtual currencies are reflected. In recent years, there have been significant changes in the attitude of most cryptocurrencies in most of the leading countries of the world, from “illegal payment” to “promising financial instrument”. The increasing interest of government in progressive innovation has led to an increase in the influx of new entrants (both individuals and institutions) who are actively using virtual currencies. Yes, cryptocurrencies have caused a lot of concern about the risks they may bring since the first digital currency, Bitcoin. Over a period of time, cryptocurrency exchanges have been steadily increasing their interest in underwriting to ensure the secure process of exchanging and buying cryptocurrencies, reducing theft. Virtual currencies contain a large amount of capitalization in terms of fiat currencies, but the disorder and even the unstable state of cryptocurrencies, as well as the lack of historical loss data, complicate the process of controlling their turnover. However, given the interest, popularity and attention of the media, many, including lawyers, political scientists, economists, are trying to understand the basics of technology and its implications for politicians and other departments. The development of blockchain-based cryptocurrency technology has been introduced in areas that have traditionally been widely regulated, such as capital raising and money transfer. Politicians and other government officials often try to apply laws that have been developed for decades for the latest technology. The US in each state has a different definition and approach to cryptocurrency transactions. A similar situation is observed in the international arena, where some countries have sought to promote the growth of technology and others have sought to remove technology from their jurisdiction. Therefore, the legal field of law requires in-depth research and analysis on virtual currency transactions, the development and implementation of a new cryptocurrency exchange rate verification mechanism that is similar to those existing for traditional financial processes.

Actual problems of defining the legal status of cryptocurrencies in the context of forming a digital interdependence (economic law aspect)

Дмитро Ігорович Погрібний

The article discusses current approaches to determining the legal status of cryptocurrencies in order to create effective mechanisms of economic and legal support for their use in Ukraine. Attention is drawn to such a necessary factor as cooperation in the digital sphere between the state, individuals, and groups in the context of the «digital interdependence» paradigm, which was formulated at the #EuroDig2019 UN Digital Interdependence Report. The process of transformation of existing approaches to defining the economic and legal nature of cryptocurrencies by leading countries and international financial regulators is analyzed. The advantages and disadvantages of using cryptocurrencies have been systematized, as well as the genesis of such cryptocurrency as Bitcoin. It is determined that cryptocurrency is a new stage after the first electronic money, as well as the main advantages of its use, namely: instantaneous speed of payments (from a few seconds to several minutes); absence of transaction commission; anonymity of calculations; irreversibility of payments; no need to convert to the currency of the country of production of payments, a high degree of security of operations. The previous attempts of public authorities in Ukraine to establish a legal regime for the cryptocurrency market by adopting relevant regulatory legal acts in this area are analyzed. The ways of optimization of the legislation on cryptocurrencies in Ukraine are proposed in order to significantly enhance the innovative component of the Ukrainian economy and create competitive advantages for economic entities

Grigorii Ursol, Alexandr Skrypnyk, O. M. Vasylenko

The article analyzes the strengths, weaknesses, potential opportunities and threats in the process of forming and making appropriate management decisions to integrate health facilities into united territorial communities (UTC) infrastructure, or other options, in the process of decentralization. The basic package of new legislative and regulatory documents has been worked out, which envisages radical changes and systemic reforms, decentralization of power - transfer from the executive bodies to local self-government bodies of a considerable part of powers, resources and responsibilities. A number of reform changes have been identified, which may lead to the expected institutional, organizational and structural-functional changes of the existing public health management system in Ukraine and changes in the individual functional characteristics of the entities of this system. The differences between medical reforms in terms of administrative reform, the role of UTC in this process, in relation to a number of other European countries are considered. On this basis, possible options for the development of events in the context of territorial governance of these processes in the system of health in Ukraine have been proposed. In order to continue scientific research in this direction, the next stage of the evolution of the formation and adoption of appropriate management decisions in the UTC is to consider the cooperation of the UTC in the creation of joint infrastructure medical facilities, their governing bodies, implementation of projects of activity, financing and maintenance.

Implementing the Blockchain Technology in the Financial Services Industry

Edward Chen

The focus of this chapter will be on how this blockchain technology should be appropriately implemented in the financial services industry. Once widely overlooked by many due to its association with the controversial digital currency Bitcoin, the underlying technology, the blockchain, has since become a large area of focus for most major financial institutions. At its core, the blockchain serves as an immutable, secure, distributed ledger shared among the participants connected to it. The primary attributes of the blockchain, including transparency, speed of settlement, security, and automation, have the potential to significantly change the way financial institutions operate today. This chapter will also address the implications of moving towards a blockchain general ledger and the hurdles that must be overcome.

CRYPTOCURRENCIES: DEVELOPMENT, FEATURES AND CLASSIFICATION

Mykola Kucheryavenko, Olga Dmytryk, Oleksandr Golovashevych

The advent of cryptocurrencies and rapid growth of crypto-networks heralded a new era in evolution of financial relations. The main goals achieved by introduction of cryptocurrencies included: a) removal of the third party (the government, banking and financial institutions) from transactions between the parties to a transfer; b) anonymity of the parties; c) transaction security. The governments of various countries of the world have a different stance as regards the use of cryptocurrencies, and in some cases, they consider this medium of exchange illegal. The transnational nature of transactions involving cryptocurrencies and the absence of physical borders for these transactions complicate legislative regulation of the circulation of cryptocurrencies in Ukraine. The use of cryptocurrencies has significant effect on the economies of Ukraine and other countries of the world due to easy dissemination and popularity of this technology and the growing capitalization of cryptocurrencies. The exchange of cryptocurrencies into fiduciary money and the possibility of gaining substantial profits on a cryptocurrency exchange due to high volatility of cryptocurrencies necessitate development, as soon as possible, of approaches to legislative regulation of both terminological apparatus related to circulation of cryptocurrencies and the exchange transaction procedures, profit taxation, etc. Considering the multisided nature of crypto-networks and the diversity of cryptocurrencies currently existing in the world (over 2000 variants as of today), classification of existing cryptocurrencies and definition of their features represents a contemporary task. This article characterizes development of blockchain technology that serves as the basis for the functioning of cryptocurrencies, defines their characteristic features, positive and innovative concepts implemented with their advent. Cryptocurrencies were classified based on various criteria (issue type, network decentralization, limitation on issue, controllability of cryptocurrency issue, etc.), and two groups of features typical either for all cryptocurrencies or for their certain variants were proposed. It was proposed to define a cryptocurrency as a variety of e-money used as an alternative additional currency and circulated within global computer networks on the basis of blockchain technology that envisages asymmetrical encryption and the use of various cryptographic protection methods.

Legal Regulation Of Cryptocurrency Taxation in European Countries

K.V. Solodan

The features of legislation concerning taxation of cryptocurrency in different countries of Europe are analyzed in this article. The author uses the anthroposociocultural approach as the basis for the study of the problem. From the point of view of anthroposociocultural approach, the necessity of proper legal regulation of taxation of cryptocurrencies has been determined to ensure the realization of the human right to taxes. The legal regulation of taxation of cryptocurrency at the European level is analyzed. The author notices that there is still no unified approach to defining what cryptocurrencies are, and how countries can develop a common policy for taxing them. This is due partly to the anonymity of users, and partly to the ambition of virtual currencies to circumvent traditional financial institutions. The author specifies what taxes can cryptocurrencies be taxed by (tax on income, capital gains tax), analyzes European approaches to solving the problem of taxation of cryptocurrencies. The author notes that Eastern Europe states have more simple and attractive tax rates. The author of the article analyzes the European judicial practice in the field of taxation of IT activities, in particular cryptocurrencies, focuses on the practice of the European Court of Justice.

ORDER OF FORMATION AND USE OF LOCAL BUDGETS OF UTC IN VINNYTSIA REGION

Lyudmila Pronko, Viktor SEMENENKO

The achievements of the local self-government reform in terms of the effectiveness of management of the budget resources of the united territorial communities were determined. An analysis of the financial capacity of the budgets of the joint territorial communities of the region. The problematic aspects of the financial provision of the execution of functions by the local authorities are singled out. The ways of improving the territorial organization of power on the principles of decentralization and construction of financially self-sufficient territorial communities are proposed. Currently, financial autonomy of local budgets of UTC is provided by the relevant legal norms of the Budget Code of Ukraine. The implementation of individual steps of fiscal decentralization also expanded the financial autonomy of local budgets through: the establishment of uniform norms of deductions from national taxes; the difference between the indicative planning system of the local budgets of the Ministry of Finance of Ukraine; formation of a single basket of general fund revenues and expansion of the source of its filling; formation and putting into operation of the system of equalization of the tax capacity of the territory, etc.

INSTITUTIONAL ASPECTS OF INNOVATIVE FINANCIAL TECHNOLOGIES REGULATION IN A CRYPTOCURRENCIES DEVELOPMENT CONTEXT

Ковальчук Андрій, Yaroslav Kotlyarevskyy, S.I. Knyazev

One of the more notable developments in financial infrastructure framework during recent years has been the emergence of networking alternative financing platforms, aimed at bringing together firms and individuals looking for capital and others that have money to lend, invest or donate. That was upticked by establishment of innovative financing platforms and different business models, starting with peer-to-peer lending and equity crowdfunding and evolving to cryptocurrencies and virtual services providers. The emergence of crypto-assets is an important area of interest for regulatory authorities, including those dealing with issuance and secondary trading of crypto-assets. This article focuses on the innovative financial technologies impact phenomena, acknowledging FinTech imputed substantial benefits to the financial sector infrastructure, as well as considerable risks. Along with the analysis of theoretical developments of domestic and foreign scholars, an attention is paid to global discourse involving G20 and G7 countries, Financial Stability Board, Financial Action Task Force on Money Laundering (FATF), The International Organization of Securities Commissions (IOSCO) that raise serious regulatory and systemic concerns, as well as wider policy issues, which both need to be addressed before such projects can be implemented in full scope and integration prospects. Thus, emphasized the necessity to introduce the highest standards of financial regulation, especially with regards to anti-money laundering and counteraction to financing terrorism (AML/CFT), anti-corruption, financial transparency, accountability and inclusion in order to guarantee the stability of the financial system and consumer protection with awareness towards possible regulatory gaps. Addressing a consideration of modern developments of virtual assets regulation framework abovementio ned issues are investigated inter alia with regard to aspects of sustainable development and coordination in measures of institutional economy and Financial Law. Problems and Peculiarities of Budgeting the Activities in Socially Oriented Non-profit Organizations

Svetlana Egorova, L A Yudanova, V. A. Budasova

In the digital economy, the strengthening of the role of socially oriented non-profit organisations (NPOs) in addressing issues related to the harmonization of the social and economic aspects of society development, cannot be achieved without refocusing accounting on the solution of strategic tasks. An important tool of strategic planning and accounting in order to attract and monitor the use of earmarked funds — is budgeting, which had not been adequately reflected in the accounting activities of socially oriented NPOs. The organization of budgeting system in socially oriented non-profit organizations is based on the following characteristics: the problem of selection of calculation units; a high level of uncertainty of a profitable part of the budget, which is financed by revenues from basic and associate activities; the social orientation of the non-profit organizations, which defines the enhanced responsibility for performance and requires the clarification of the concept of operations results in itself. In the socially oriented NPO, the use of the result-oriented budgeting model, in which the expenditure of trust funds is administered in accordance with the principle of centralization on the one hand, and on the other hand, the objectives are achieved on the basis of the principles of decentralization, ensures planning, execution and monitoring of budget expenditures in direct connection with the specified, and achievable results. Under this model, the mobile annual budgets with a step equal to one month’s budgeting are used. Budget performance analysis aims to assess the quality of socially oriented non-profit organizations’ performance, which have a double-sided nature: on the one hand, the Organization’s efforts are evaluated, and on the other hand, the task force is evaluated. The effect of earmarked funds’ use becomes visible in subsequent reporting periods and is determined with regard to socially oriented NPOs within the society.

Bitcoin as an Electronic Payment Tool

Seweryn Gajdek, Sylwester Kozak

The article presents the results of research aimed at assessing the Bitcoin (BTC) capability to act as a widely accepted means of payment. The analysis includes technological and economic conditions of the BTC operation system. The research used data on market capitalization, the number of participants and the level of volatility of the BTC exchange rate in 2010-2018 from the portal coinmarketcap.com. The results of the research showed that BTC possesses certain characteristics typical of money, and has the potential to increase its share in the payment system in the future. BTC's ability to act as an electronic equivalent of cash depends on such factors as the stability of its exchange rate and the level of acceptance among users and payment acceptors. The statistical analysis of the correlation showed that along with the increase in the capitalization value of the BTC market the volatility of the exchange rate of this currency is lowered and the level of acceptance among e-commerce participants is increased. Such dependence will allow for further technological development of BTC and other cryptocurrencies and a wider use in trade.
