Regional decentralization within the framework of regional autonomy in Indonesia often creates a regulatory vacuum regarding the ownership and management of assets resulting from cooperation between the central and regional governments. This study aims to analyze the provisions of Law No. 23 of 2014 on Regional Government and to identify regulatory gaps and models for resolving conflicts over public assets following decentralization. The research method employed is a normative legal approach using legislative, conceptual, case-based, and comparative analyses. The findings reveal that Law No. 23/2014 does not explicitly regulate the status of assets during the agreement period, mechanisms for the transfer of rights and obligations, ownership proportions from multi-source financing, or compensation for the parent region. Consequently, legal uncertainty arises regarding large-scale strategic assets involving third parties. This study also found that multi-party mediation involving the governor and the prosecutor’s office proved more effective in resolving public asset disputes than litigation, as demonstrated in the Tasikmalaya case. This study recommends revising Law No. 23/2014 by adding a special chapter on the transfer of assets resulting from post-decentralization cooperation and formalizing the involvement of the prosecutor’s office in the mediation of public asset disputes.
Land is an important legal object that can be utilized by the community if it has the right to ownership of the land to be used. However, currently there are many land administration problems in various regions in Indonesia, one of which also occurs in the implementation of land administration in DKI Jakarta Province. From the existence of these problems, it can harm landowners in the DKI Jakarta Region. Researchers use qualitative research methods so that the research conducted can be more in-depth and accurate. The discussion found from this writing is that there are several problems that occur in land administration in DKI Jakarta, including the existence of people who do not use the land ownership publication system because there are still people who believe in the use of customary law, the emergence of land mafia actors who always falsify certificates for one's land ownership, and also problems in the form of KKN behavior carried out by several irresponsible land officials. On the basis of this, the author offers an NFT technology strategy, namely by digitizing land certificates by providing secret codes that will not be the same between one certificate and another. From the results of the research conducted by the author, the author concludes that there is potential for the implementation of NFT technology in the land administration of DKI Jakarta.
Since the early 1990s, various discourses have developed among government observers about government decentralization in Indonesia. Laws No. 22 and 25 of 1999 concerning Regional Government and Regional Finance, which were subsequently amended by Laws No. 22 and 33 of 2004, have led Indonesia to enter the process of decentralized governance after more than 30 years of being under the all-centralized New Order regime. The implementation of these two laws has become a momentum for the transfer of supervision, fiscal resources, political autonomy and responsibility for public services from the central government to local governments. Over the span of more than a decade of displacement, heterogeneous local experiences have surfaced, as central control over regions loosened. Local governments play a very important role in the implementation of decentralized fisheries management, apart from the central government, the community and other stakeholders with an interest in the fisheries sector, of course. They must be prepared to face challenges in managing the potential fisheries sector, so that there will be no more policies that harm the fishing community. So that the fishery sector is able to become the backbone of the country in eradicating poverty, injustice in government policies towards fishermen, and is able to become a contributor to foreign exchange for Indonesia.
Land administration and title registration system is the system for storing land title information and managing<br>transactions involving land titles. Due to the sensitivity of land issues, land administration and title registration<br>system should be strong to avoid any document forgery, available all the time, and take a short time to complete<br>tasks. Thus, this study aims at designing a model for such system based on blockchain technology. The proposed<br>model is designed using UML diagrams and then tested for verification using statistical usage models (Markov<br>chains). The proposed model integrates the Integrated Land Management Information System (ILMIS) with<br>factom and bitcoin blockchains which enables encryption of information from ILMIS to get the fingerprint<br>information of each land title and store it to the blockchains. The model further encrypts the land information<br>from ILMIS when needed and then compare it with fingerprints from blockchains for verification. Such<br>implementation of the proposed model will help ILMIS to have the capability of providing tamper proof for<br>stored data, providing the self-notarization mechanism, and availability of evidence for the land title from<br>distributed databases. Furthermore, the society is expected to benefit from this study as the time and cost for<br>registering land title will decrease and the possibilities of a piece of land having more than one owner will not be<br>there.
In the Indonesian constitutional Autonomous Region is an elaboration of territorial decentralization. Realization in the form of the rights, powers and obligations of the region to regulate and manage its own internal affairs are based on the aspirations of the people in accordance with the legislation in force. One of the objectives scrolling regional autonomy policy in Indonesia is Democratization, empowerment and public participation. To achieve this, then the government has a policy of decentralization in stages, namely the provinces given limited autonomy, greater autonomy to the district / city and country are given genuine autonomy. Community participation is a process activities performed by individuals or in groups or communities. To unify their interest or relevance to the organization or people who join in order to achieve the objectives of society itself. This study uses descriptive qualitative research methods From the results of this study, researchers found that community participation in Jatimulya village influenced by the leadership, communication and education. The result showed that the head of the village has been carrying out its role as the leader of a well, the village government communication with the public is well established and low education affects people’s participation in development planning in the Jatimulya Villa. Dalam ketatanegaraan Indonesia Otonomi Daerah merupakan penjabaran dari desentralisasi teritorial. Realisasinya dalam bentuk hak, wewenang dan kewajiban daerah untuk mengatur dan mengurus urusan rumah tangga sendiri yang berdasarkan atas aspirasi masyarakat sesuai dengan peraturan perundang-undangan yang berlaku. Salah satu tujuan pengguliran kebijakan Otonomi Daerah di Indonesia adalah Demokratisasi, Pemberdayaan dan Partisipasi publik. Untuk mencapai hal tersebut maka pemerintah menggulirkan kebijakan desentralisasi secara bertingkat, yakni kepada provinsi diberikan otonomi terbatas, otonomi luas kepada daerah kabupaten/kota dan Desa diberikan otonomi asli. Partisipasi masyarakat merupakan suatu proses kegiatan yang dilakukan oleh perorangan maupun secara berkelompok atau masyarakat. Untuk menyatukan kepentingan atau keterkaitan mereka terhadap organisasi atau masyarakat yang bergabung dalam rangka pencapaian tujuan masyarakat itu sendiri. Penelitian ini menggunakan metode penelitian deskriptif kualitatif. Dari hasil penelitian di dapatkan bahwa partisipasi masyarakat di Desa Jatimulya di pengaruhi oleh kepemimpinan, komunikasi dan pendidikan. Dari hasil penelitian diperoleh bahwa kepala Desa telah melaksanakan perannya sebagai pemimpin dengan baik, komunikasi pemerintah Desa dengan masyarakat terjalin dengan baik dan rendahnya pendidikan masyarakat mempengaruhi partisipasi dalam perencanaan pembangunan di Desa Jatimulya
