Spanish Abstract: El desarrollo de la tecnología blockchain plantea importantes retos jurídico-privados respecto del derecho de propiedad, de los cuales los más relevantes se suscitan en materia de contratación electrónica y transmisión digital. El origen de la smart property depende de la adquisición de los derechos reales, ex art. 609 CC: para la adquisición originaria, debe producirse directamente la tokenización del bien en una plataforma blockchain, para su control remoto; y, en la adquisición derivativa, mediante la celebración de un smart contract traslativo en una plataforma blockchain para, posteriormente, utilizar dicha tecnología para tokenizar el objeto del contrato en la plataforma. English Abstract" The development of blockchain technology poses significant private-legal challenges for property law, the most important of which arise in the areas of electronic contracting and digital transmission. The origin of smart property depends on the acquisition of rights in rem, ex art. 609 CC: for the original acquisition, the tokenisation of the property must take place directly on a blockchain platform, for its remote control; and, in the derivative acquisition, through the conclusion of a smart contract on a blockchain platform to subsequently use this technology to tokenise the object of the contract on the platform.
