La transmisión de la propiedad inmobiliaria mediante la tecnología blockchain en Europa. (The Transfer of Real Estate through Blockchain Technology across Europe)

Spanish abstract: La vinculación entre la tecnología blockchain y el derecho de propiedad presenta diversos retos para el Derecho civil, por su desregulación y la reformulación de los remedios existentes. En atención a la importancia creciente de las nuevas tecnologías en este ámbito, este trabajo configura la transmisión de la propiedad inmobiliaria mediante las nuevas tecnologías en Europa. A estos efectos, se propone una teoría general y remedios, así como la aplicación práctica de la Tokenización, el Internet of Things, y la tecnología blockchain al Registro de la Propiedad. English abstract: The link between blockchain technology and property law presents a number of challenges for civil law in terms of deregulation and the reformulation of existing remedies. In view of the growing importance of new technologies in this field, this paper shapes the transfer of real property through new technologies in Europe. To this end, a general theory and remedies are proposed, as well as the practical application of tokenisation, the Internet of Things, and blockchain technology to land registration.
