Unravelling the Legal Framework for Cryptocurrency: A Comparative Analysis of Regulatory Approaches
Abstract
This research focuses on one of the most prominent challenges of our time: the rise of cryptocurrencies, which marks a significant shift away from traditional tangible money. Cryptocurrencies, such as Bitcoin, are highly encrypted, making it challenging to trace their movement or identify the traders involved. This has led authorities to issue warnings regarding the risks associated with cryptocurrencies, while some governmental institutes and authorities have established legal frameworks to adapt to this new virtual era and technological development that is rapidly transforming the global financial landscape. The importance of cryptocurrencies is emphasized by the lack of comprehensive legislation governing their use. The growth of e-commerce, advancements in technology, and the proliferation of online payment methods have contributed to the widespread adoption of cryptocurrencies, garnering both supporters and opponents. Consequently, the need for a comparative analytical study has arisen to define cryptocurrencies, their origins, their legal nature, the challenges they pose in trading, the different legislative perspectives surrounding them, and an examination of the most significant risks involved. The study has yielded several crucial findings that shed light on these enigmatic cryptocurrencies. Foremost among these findings is the fact that most countries do not recognize cryptocurrencies, and they lack a legal and regulatory framework to govern their trading and exchange rates. This absence of regulation increases the risk of a collapse in the value of cryptocurrencies, potentially resulting in substantial monetary losses for users.
