Criminal Procedure and Law within the Context of the Educational Environment

Abstract

This chapter begins with a concept of how we as society conceptualize age in education and educational contexts. It considers the educational environment should not be a factor in whether First, Fourth, Fifth, Sixth or Fourteenth Amendment rights. In schools their primary role is educating their students; however, they are also responsible for student discipline, operational policies and procedures, and law compliance. Criminal suspects in the United States in police custody before they are interrogated must be notified of the admissibility of their statements against them in criminal proceedings. With a youth’s freedom at stake, the US Supreme Court had to consider the long-term implications of proof in juvenile court disposition. The court actually restricted student free speech, stating it was allowed and acceptable as long as it did not interfere or disrupt learning in the classroom or impinge on the rights of others.
