Abstract
This chapter provides a comprehensive overview of the legal and regulatory landscape surrounding Web3. The chapter explores the challenges that decentralized technologies face, including the application of traditional laws to crypto projects, intellectual property issues, and data protection in a transparent blockchain environment. It discusses various frameworks – from securities laws and e-money regulations to anti-money laundering (AML)/counter-terrorist financing (CTF) requirements and VASP guidelines – highlighting the need for robust compliance strategies as jurisdictions worldwide tighten oversight. Real-world examples, such as the U.S. Securities and Exchange Commission’s (SEC) actions and international regulations like Markets in Crypto-Assets (MiCA), illustrate how these rules impact project structure and operations. The chapter also emphasizes the role of smart contracts in automating compliance and the importance of risk management in a rapidly evolving digital economy.
